What the Real Estate SureStay Plus Agreement Is

The Real Estate SureStay Plus Agreement is a standardized contract used to document terms between a property owner or manager and a guest, tenant, or licensee for short-term or extended stays. It typically covers occupancy dates, payment terms, security deposits, maintenance responsibilities, liability allocations, housekeeping and access rules, and cancellation policies. The form establishes each party's rights and obligations, creates a written record for dispute resolution, and can be executed electronically where state law permits.

Why a Clear SureStay Plus Agreement Matters

A properly drafted Agreement reduces ambiguity about payments, deposits, maintenance, and liability, helps manage expectations, and improves enforceability. It centralizes terms for all parties, supports compliance with local disclosure rules, and simplifies enforcement or claims processes when disputes arise.

Why a Clear SureStay Plus Agreement Matters

Who Typically Prepares and Signs This Agreement

Several roles interact with the Real Estate SureStay Plus Agreement depending on the transaction: property owners, managers, agents, and guests each have responsibilities in preparation and execution.

  • Property managers: Draft, deliver, and enforce terms; handle payments and maintenance coordination.
  • Owners and investors: Review liability clauses, security deposit treatment, and revenue provisions.
  • Guests and tenants: Confirm identity, payment method, and acceptance of house rules and damages policy.

Clear role assignment upfront reduces signing delays and supports faster execution, whether handled in person or via electronic signature platforms.

Common Preparation and Execution Mistakes to Avoid

  • Using initials instead of full signatures, which can raise enforceability questions in disputes or claims.
  • Leaving payment fields blank or ambiguous, which creates grounds for late-payment disputes and collection issues.
  • Failing to specify the governing state, causing uncertainty if parties are in different jurisdictions.
  • Not verifying signer authority when an agent signs on behalf of an owner or corporate entity.

Potential Penalties and Legal Risks from Errors

Unenforceable Terms: Ambiguity can void specific contract provisions
Deposit Disputes: Improper handling risks statutory penalties
Unauthorized Signatures: May lead to contract avoidance claims
Privacy Violations: Inadequate safeguards risk data protection issues
Late Filings: Missed notices can forfeit remedies
Statutory Noncompliance: State-specific violations carry fines or damages
