Client represents that Client has authority to grant Surveyor reasonable access to the Property and to provide required documentation. Client shall provide copies of existing surveys, title commitments, recorded easements, and any other documents reasonably required by Surveyor:

Fees, Payment and Additional Services

Client agrees to pay Surveyor the fee of $ for services described herein. A deposit of $ is due upon execution of this Agreement. Balance due upon delivery of final deliverables or within days of invoice.

Reimbursable expenses (maps, plats, locator fees, recording fees, travel) shall be invoiced in addition to the fee. Client shall reimburse such expenses upon receipt of invoice.

Surveyor Certification, Use and Reliance

Upon completion, Surveyor will provide appropriate certification signed and sealed by a professional land surveyor licensed in the jurisdiction of the Property. The certification applies only to the work performed and to those deliverables expressly provided to Client. Any use by third parties not named in this Agreement is at Client's sole risk unless Surveyor expressly consents in writing.

Ownership of Documents and Records

Original field notes, drawings and electronic files prepared by Surveyor are the property of Surveyor. Surveyor grants Client a limited license to use deliverables for the specific project and Property described in this Agreement. Reuse or alteration of deliverables for other purposes is prohibited without Surveyor's prior written consent and may relieve Surveyor of liability.

Insurance, Indemnity and Limitation of Liability

Surveyor maintains professional liability insurance in amounts customary for the surveying profession. Client agrees to indemnify and hold Surveyor harmless from claims arising from Client-supplied information, unauthorized use of deliverables, and third-party claims not caused by Surveyor's negligent acts or omissions.

Surveyor's total liability for any claim arising from or related to this Agreement shall not exceed the greater of the fee paid under this Agreement or the amount of Surveyor's applicable insurance recovery for the claim. In no event shall Surveyor be liable for consequential, incidental, special or punitive damages.

Default, Termination and Remedies

Either party may terminate this Agreement for material breach upon providing written notice and a reasonable opportunity to cure. Surveyor may suspend work for nonpayment after providing notice. Upon termination, Client shall pay Surveyor for all services performed and reimbursable expenses incurred to the date of termination.

Governing Law and Entire Agreement

This Agreement shall be governed by the laws of the state of . This instrument contains the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations and understandings.
