Owner represents and warrants that, to the best of Owner's knowledge, the information provided herein regarding the availability and location of any survey copy is true and complete. Owner agrees to provide any original or reproducible copy of an available survey to Requesting Party or Requesting Party's designee upon request.

If no current survey is available, Owner hereby authorizes Requesting Party to order a new field survey of the Property, subject to the terms below: Requesting Party will provide written notice to Owner prior to entry for field work; Requesting Party will be responsible for all costs associated with the new survey unless otherwise agreed in writing; any work requiring access to adjacent private property will require separate consent of that parcel owner.

Access to the Property for purposes of performing a survey is: Granted by Owner. If access is not granted, Requesting Party may require Owner to procure survey documentation or bear the cost of alternatives.

Reliance: Any survey provided is accepted by Requesting Party subject to verification. Requesting Party is solely responsible for determining the adequacy of any existing survey for its intended use. Owner makes no warranty as to the legal sufficiency, accuracy, or current conformity of any survey beyond Owner's actual knowledge.

Indemnification: Requesting Party agrees to defend, indemnify and hold Owner harmless from and against any claims, liabilities, damages or costs (including reasonable attorneys' fees) arising from Requesting Party's entry on the Property or from the conduct of surveys ordered by Requesting Party, except to the extent caused by Owner's gross negligence or willful misconduct.

Limitations: Nothing in this Notice obligates Owner to perform or pay for a new survey unless mutually agreed in writing. Any survey delivered by Owner is for informational purposes only and does not amend or alter any recorded instruments affecting the Property.

Miscellaneous

Governing Law: The obligations and interpretation of this Notice shall be governed by the laws of the state of without regard to conflict of laws principles.

Entire Agreement: This Notice constitutes the entire agreement between the parties with respect to survey availability and supersedes any prior oral or written representations on the same subject unless expressly incorporated by written amendment signed by both parties.
