What the Real Estate Title Commitment Form Is

A Real Estate Title Commitment Form is a preliminary statement issued by a title company that identifies the current owner, describes the property, and lists conditions, exceptions, and requirements for issuing a final title insurance policy. It reports liens, easements, judgments, and matters affecting marketable title and establishes the seller's and buyer's closing obligations. Lenders rely on the commitment to confirm collateral status. The form does not transfer title; it documents contingencies that must be satisfied before issuance of the title policy.

Why a Title Commitment Matters for Transactions

A title commitment clarifies title defects, required cures, and policy exclusions so buyers, sellers, and lenders know risks before closing. It reduces post-closing surprises and frames closing deliverables.

Why a Title Commitment Matters for Transactions

Who Prepares, Reviews, and Relies on the Form

Typical participants review the title commitment to confirm ownership, liens, and exceptions before closing.

  • Title companies and settlement agents examine public records and prepare the commitment for the transaction.
  • Buyers and their attorneys review exceptions and requirements to evaluate marketability and needed curative steps.
  • Lenders use the commitment to determine insurability and set payoff or lien release conditions.

Each party should address listed requirements early to avoid closing delays and ensure the final policy can be issued.

Step-by-Step: Completing a Title Commitment Form

Follow these sequential actions to prepare, verify, and clear items listed on the title commitment prior to closing.

  • 01
Order Search: Title company orders public-record search for ownership and liens.
  • 02
Draft Commitment: Underwriter compiles commitment showing exceptions and requirements.
  • 03
Review & Identify: Buyer, lender, and counsel review exceptions and curative tasks.
  • 04
Satisfy Requirements: Obtain releases, payoffs, or corrected instruments before closing.

How to Configure an Online Title Commitment Workflow

Set up a consistent digital workflow to collect, review, and clear title exceptions with role-based routing and required fields.

Field Configuration

Digital Signing and Platform Needs for Title Commitments

Choose a platform that supports PDF, audit trails, conditional fields, and secure authentication for parties and vendors.

  • File Formats: PDF, DOCX import and export
  • Integrations: Connectors for MLS, CRM, and document storage (Salesforce, NetSuite, Google Workspace)
  • Security: TLS 1.2/1.3 in transit, AES-256 at rest

Ensure the platform supports audit trails, conditional logic for endorsements, and HIPAA/21 CFR/ESIGN compliance where required.

Where to Send, File, and Store the Commitment

Route the commitment to stakeholders and file supporting documents with the closing agent, lender, and county recorder as appropriate.

  • Recipient Distribution: Send finalized commitment to buyer, seller, lender, and closing attorney
  • County Recording: Record deeds and releases at the county recorder's office where the property is located
  • Lender Delivery: Provide lender with the commitment and conditions for loan closing
  • Archive Copy: Store signed commitment and closing package in secure document repository
