What the Real Estate TREC Addendum Is and When It Applies

The Real Estate TREC Addendum is a standardized Texas Real Estate Commission form used to modify, supplement, or clarify terms in residential purchase contracts governed by TREC contracts. It documents agreed changes such as financing, repairs, closing date adjustments, contingency language, and other negotiated provisions while preserving the original contract's structure. Agents, buyers, and sellers use it to record mutually accepted amendments in writing so they are enforceable and clear. Properly completed, dated, and signed addenda become part of the contract and establish precise obligations, deadlines, and responsibilities for each party involved in the real estate transaction.

Why a Clear TREC Addendum Matters in Transactions

Using the Real Estate TREC Addendum ensures contract changes are documented consistently, reduces ambiguity about obligations and timelines, and creates an enforceable, written record to protect buyer, seller, and broker interests under Texas real estate practice.

Why a Clear TREC Addendum Matters in Transactions

Which Parties Commonly Complete a TREC Addendum

Real estate agents, buyers, and sellers commonly complete the Real Estate TREC Addendum when negotiated contract terms require written modification or clarification.

  • Listing agents: document seller-approved changes to contingencies, repairs, or closing timelines.
  • Buyers: record inspection results, financing adjustments, or seller concessions agreed during negotiation.
  • Lenders/attorneys: ensure contract amendments align with financing conditions and legal review.

Broader transaction teams, including title companies and escrow officers, also rely on the addendum to confirm updated closing instructions and documents.

Common Drafting Mistakes to Avoid

  • Failing to reference the exact paragraph or provision in the original contract leads to ambiguity and potential disagreement about the intended amendment.
  • Using vague phrases such as 'reasonable time' or 'as agreed' can create interpretive disputes and delay closing or enforcement.
  • Not attaching the signed addendum to every contract copy causes confusion for escrow, title, and lending parties and may nullify changes.
