Any deviations from the scheduled scope must be approved in writing by the Property Owner prior to execution.

Materials, Performance & Compliance

Installer warrants that all windows and materials supplied conform to the specifications listed above and applicable building codes at the time of installation. Installer shall supply manufacturer product data and NFRC or equivalent certification labels where applicable. Installer is responsible for obtaining any permits required for installation unless otherwise noted below.

Pricing, Payment & Deposits

Payment terms: Owner shall pay the deposit indicated above upon acceptance. Remaining balance due per the payment schedule agreed in writing or upon substantial completion. Late payments shall incur interest at a rate of 1.5% per month or the maximum permitted by law, whichever is less.

Installer warrants materials to be free from manufacturer defects for the manufacturer-specified warranty period. Installer warrants workmanship for a period of years from date of completion. This warranty does not cover damage caused by misuse, abuse, acts of God, subsequent alterations, or failure to maintain. Installer shall maintain liability insurance and workers' compensation coverage as required by law; proof of insurance shall be provided upon Owner's request.

Default and Remedies

If either party materially breaches this specification and related contract, the non-breaching party shall provide written notice specifying the breach. The breaching party shall have fourteen (14) days to cure the breach where reasonably curable. If not cured, the non-breaching party may pursue remedies at law or equity, including termination, damages, or specific performance. Recovery of attorneys' fees and costs shall be governed by the controlling contract between the parties when expressly provided.

Governing Law; Entire Agreement

This document and any incorporated contract documents shall be governed by the laws of the state where the Property is located. This Window Specs form, together with any signed purchase order, estimate, or contract incorporated by reference, constitutes the entire agreement between the parties with respect to the subject matter herein and supersedes all prior negotiations and representations.
