What a Realtor Buyer Agreement Is and when it applies

A Realtor Buyer Agreement is a written contract between a prospective purchaser and a real estate licensee or brokerage that defines the scope of buyer representation, broker duties, compensation, and the agreement term. It clarifies whether the agent acts as an exclusive or non-exclusive buyer representative, describes agency relationships and disclosures, and records contingencies, timelines, and any commission arrangements the parties accept. The agreement protects both buyer and broker by setting expectations for property searches, showings, negotiation authority, and whether the broker may accept dual agency in a transaction.

Why a written Buyer Agreement matters in real estate transactions

A clear Realtor Buyer Agreement reduces misunderstandings about services, fees, and agency duties, and documents consent for electronic delivery and communications when used. It helps allocate responsibility for disclosures, establishes commission expectations, and creates a record useful in any later dispute or regulatory review.

Why a written Buyer Agreement matters in real estate transactions

Who signs and relies on a Realtor Buyer Agreement

Executing the agreement early in the purchasing process protects both parties and streamlines interactions with lenders, title companies, and other transaction participants.

  • Buyer — An individual or entity seeking representation and clarity on agent duties, search criteria, and compensation terms.
  • Agent / Broker — The listing of brokerage name, supervising broker, and license details to document who provides services and enforces firm policy.
  • Lender or Attorney — Copies often go to a mortgage lender or counsel for underwriting and review during contingency or closing stages.

Essential parts of a professional Realtor Buyer Agreement

A complete Buyer Agreement lays out parties, scope, compensation, agency disclosures, timelines, and termination terms so both buyer and broker understand obligations and remedies.

Parties & Term

Names of buyer(s) and broker, brokerage license info, and the agreement start and end dates, including automatic renewal or extension rules.

Scope of Representation

Geographic and property-type limits, buyer search criteria, and the broker’s responsibilities for showings, negotiating offers, and presenting written summaries.

Compensation

Commission amount or formula, who pays it, how cooperating broker fees are allocated, and conditions that trigger payment, including post-termination protections.

Agency Disclosure

Clear statement of agency relationship, whether dual agency is allowed, and required state-specific disclosure language about duties and conflicts of interest.

Contingencies & Deadlines

Key dates such as inspection, financing, appraisal deadlines, earnest money schedule, and how missed deadlines affect termination or default.

Termination & Amendments

How parties may end or modify the agreement, notice requirements, and whether broker retains a right to compensation for properties shown during the term.

Step-by-step: completing a Realtor Buyer Agreement

Follow a consistent sequence to reduce errors and ensure all parties receive required disclosures and copies of the executed agreement.

  • 01
Gather documents: Collect buyer ID, proof of funds, and broker license information before filling fields.
  • 02
Define terms: Agree on scope, compensation, and search criteria with the buyer in writing.
  • 03
Insert dates: Set effective date and all contingency deadlines in MM/DD/YYYY format.
  • 04
Sign and distribute: Obtain signatures from buyer and authorized broker representative and deliver copies to all parties.

Where to keep and who to send executed Buyer Agreements

A signed Buyer Agreement is a private contract. Maintain copies at the brokerage and provide copies to the buyer and any authorized representatives.

  • Brokerage File: Retain an executed copy in the brokerage’s transaction files per firm policy and state rules.
  • Buyer Copy: Provide the buyer a dated signed copy immediately after execution.
  • Lender / Attorney: Share with buyer’s lender or attorney when requested for underwriting or legal review.
  • Cooperating Broker: Send copies to cooperating brokers if commission or showing agreements reference their role.

Electronic completion and file formats for digital workflows

Ensure the chosen platform preserves a tamper-evident final PDF, an audit trail of signer activity, and retention options that meet state and federal requirements.

  • Document formats: PDF and DOCX supported for upload and archival.
  • Authentication methods: Email link, SMS code, or stronger signer authentication options.

  • Using unsigned or partially signed agreements that lenders or counterparties will not accept or that undermine enforcement.
  • Failing to include required state-specific agency disclosures, which may violate licensing rules and expose the broker to sanctions.
  • Neglecting to set clear contingency deadlines and cure periods, which can lead to missed termination windows or lost deposits.

Consequences of incomplete or incorrect Buyer Agreements

Unenforceable commission: May occur
Regulatory fines: Possible under state real estate law
Contract disputes: Litigation or arbitration risk
Loan delays: Lender underwriting impact
Title issues: If property description is wrong
Data privacy exposure: If PII handled insecurely
