What the Realty Partners Listing Agreement Does and when to use it

The Realty Partners Listing Agreement is a written contract that defines the relationship between a property owner and a broker when marketing real property for sale or lease. It documents parties, property description, listing price, commission terms, exclusivity, listing term, broker duties, and required disclosures. The agreement authorizes the broker to advertise, show, and place the property on the MLS where applicable, and it creates enforceable compensation obligations when a qualifying buyer procures a contract during the listing term. Use it at the start of a listing engagement to set expectations and reduce disputes.

Why a clear listing agreement matters for sellers and brokers

A complete Realty Partners Listing Agreement clarifies agency relationships, protects commission rights, ensures disclosure compliance, and documents marketing authority so both parties understand timelines and obligations before showings or offers begin.

  • Omitting exhibit disclosures (HOA docs, lead-paint) required by state law, potentially exposing the seller to post-closing claims.
  • Not obtaining signatures from all title holders, authorized signers, or an attached power of attorney when an entity owns the property.

Risks and potential consequences of an incomplete or incorrect agreement

Commission dispute: Broker may face challenges enforcing compensation
MLS penalties: Fines or listing removal for incorrect data
Contract voidance: Material errors can render clauses unenforceable
Closing delays: Incorrect names or missing documents delay title work
Regulatory fines: Disclosure violations may incur penalties
