RECREATIONAL HOT TUB USAGE AGREEMENT

WHEREAS

WHEREAS, Owner is the lawful owner or authorized custodian of the recreational hot tub and related equipment located at the premises described below; and

WHEREAS, User desires to use the hot tub for recreational purposes subject to the terms, conditions and safety requirements set forth in this Agreement; and

WHEREAS, Owner is willing to permit limited use of the hot tub upon User's agreement to assume certain risks, to comply with operational and safety procedures, and to indemnify Owner for certain liabilities.

User shall comply with all posted rules and the following mandatory safety requirements. User's failure to comply constitutes a material breach and grounds for immediate termination of use.

PAYMENT TERMS

In consideration for permission to use the hot tub, User agrees to pay Owner the fees and charges as set forth below.

All payments are non-refundable except as expressly provided herein. Owner may suspend User's access for non-payment after providing notice as required by this Agreement.

TERM AND TERMINATION

This Agreement commences on and continues until unless earlier terminated as provided below.

CONFIDENTIALITY

Each party shall keep confidential any proprietary or personally identifying information disclosed by the other party in connection with this Agreement and shall not disclose such information to third parties except as required by law or with prior written consent. Confidential information does not include information that is or becomes public through no breach of this Agreement, independently developed by the recipient, or rightfully obtained from a third party without restriction.

ASSUMPTION OF RISK, LIABILITY AND INDEMNIFICATION

User acknowledges that use of a hot tub involves inherent risks including but not limited to slips, falls, drowning, burns, adverse health effects, and exposure to chemicals. User accepts all such risks and agrees that Owner shall not be liable for injury, loss, or damage caused by ordinary negligence of Owner, except to the extent such liability cannot be waived under applicable law. User shall indemnify, defend and hold harmless Owner from and against any and all claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of User's use of the hot tub, breach of this Agreement, or negligence or willful misconduct of User or User's invitees.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to conflict of law principles. Any legal action relating to this Agreement shall be brought in the appropriate state or federal court located in that State.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior and contemporaneous agreements, understandings and representations, whether written or oral.
