Release and Waiver of Liability Given by Customer and/or Property Owner in Favor of Owner of Mobile Trailer Housing Video Games Whereas, _____________________________________ (Name of Owner of Mobile Trailer ) of ______________________________________________________________________________ (street address, city, state, zip code) , hereinafter called Owner , provides a mobile trailer which houses video games for recreational purposes (the Trailer ) at various locations; and Whereas, the undersigned _______________________________________ (name of customer) , hereinafter called Customer , desires to rent said Trailer from Owner from (date) to (date) with the Trailer to be placed at ________________________________________________________ _______________________ (street address, city, state, zip code) ; and Whereas, Customer will be renting Trailer for the following purpose(s); (describe purposes such as special event, carnival, fund raiser, birthday, bachelor party, etc.); and Whereas, Owner will not rent a Trailer to C ustomer unless Customer agrees to the terms of this Agreement; Now, therefore, for and in consideration of being allowed to rent said Trailer as aforesaid, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Customer releases Owner, his/her employees, agents, and assigns (collectively Releasees) from all liability to the undersigned for any loss or damage to property, physical injury or death whether caused by Releasees or otherwise that result, directly or indirectly from the rental of Trailer by Customer. 2. Customer releases Releasees from all liability to the undersigned and, to the extent allowed by law, to any guests of Customer, for any loss or damage to property, physical injury or death whether caused by Releasees or otherwise, that result, directly or indirectly from the participation, directly or indirectly, in the video games housed in the Trailer. 3. Customer agrees to indemnify, save and hold Releasees harmless from any loss, liability, attorneys’ fees, damage, or costs that they (or any of them) may incur arising out of or related to the participation of the Guests of Customer in the video games housed in the Trailer; whether caused by the negligence of the Releasees or otherwise. 4 . Customer agrees to return the mobile trailer and video games in the condition as it was when delivered to Customer , ordinary wear and tear resulting from proper use alone excepted. Customer shall be personally liable to Owner for any damages to the mobile trailer and/or video games that exceed the sum of $_______________. 5. Customer understands that Owner has a rating system regarding the use by minors of the video games, and Customer assumes responsibility to see that his guests abide by this system. 6. This Agreement shall be governed by the laws of the State of ______________________ and the Parties agree that any legal action relating to or arising out of this agreement shall be brought exclusively in binding arbitration in __________________________________________ (city, state) and subject to the Rules of the American Arbitration Association.
