Fill and Sign the Release of Landlord Waiver of Liability and Assumption of All Risks of Personal Bodily Injury Regarding a Play Structure Form

Release of Landlord, Waiver of Liability, and Assumption of all Risks of Bodily Injury Regarding a Play Structure (Including a Swing Set) Owned by Landlord and Located on Landlord = s Property Being Rented to Tenant Whereas, ___________________________________________ (Names of Landlords), hereinafter called ___________________________ Landlords , own the house and lot located at ________________________________________________________________ (street address, city, county, state, zip code) , hereinafter called _____________________ Premises; and Whereas the undersigned _________________________________ (Names of Tenants), hereinafter called ____________________ Tenants, have signed a lease with Landlords to rent Premises from ______________ (date) until _________________ (date); and Whereas, Landlords own a play structure including a swing set ___________________ (Swing Set) which is located in the backyard of Premises; and Whereas, Tenants desires that their family including their minor child or children _______________________________ (names of minor child or children) and guests be allowed to use said Swing Set; and Whereas, the execution of this agreement is a condition set by Landlords for the use of the Swing Set in the matter described aforesaid; Now, therefore, for and in consideration of being allowed to use the Swing Set as aforesaid, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned Tenants , individually and on behalf of ______________ (names of minor child or children) , release the _______________ Landlords from all liability to either of us and/or ________________________ ( names of minor child or children) , for any loss or damage to property, physical injury or death to said Tenants and/or minor child or children whether caused by Landlords or otherwise that result, directly or indirectly from the use by said Tenants , minor child or children or anyone else using the Swing Set with the permission of Tenants or due to the failure of Tenants to adequately secure the Swing Set from trespassers. The undersigned Tenants further agree to indemnify, save and hold Landlords harmless from any loss, liability, attorneys = fees, damage, or costs that they (or either of them) may incur arising out of or related to the use of said Swing Set and/or the surrounding area by said Tenants , minor child or children or anyone else using the Swing Set with the permission of Tenants or due to the failure of Tenants to adequately secure the Swing Set from trespassers, whether caused by the negligence of the Landlords or otherwise. The undersigned Tenants covenant and represent that we have read this document; and that we voluntarily signed this Release, Waiver of Liability and Assumption of Risk. We have inspected the Swing Set and the surrounding area and both appear safe. This Agreement shall be governed by the laws of the State of ____________and the Parties agree that any legal action relating to or arising out of this agreement shall be brought in binding Arbitration in ___________________________ (city, state) and subject to the Rules of the American Arbitration Association .
