Release of Landlord, Waiver of Liability, and Assumption of all Risks of Bodily Injury Regarding Ponds Owned by Landlord and Located on Landlord = s Property Whereas, the undersigned __________________________________ (Tenants) are renting a house located at _______________________________________________ ( street address, city, state, zip code) , on property owned by ________________________ (Landlord) ; and Whereas, Tenants have a minor child named __________________________ (Child); and Whereas, there are two small ponds located on said property, and Landlord has warned Tenants of the dangers to said Child that could result if Child goes into one of the ponds without adequate supervision of Tenants; and Whereas, Tenants have assumed the risk of such dangers and released Landlord for any injury or loss of life to Tenants and/or Child; and Whereas, Tenants and Landlord want to memorialize said assumption of risk and release in writing; Now, therefore, for and in consideration of being allowed to rent said house, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned Tenants do hereby release Landlord, his heirs, successors, and assigns (collectively Releasees) from all liability to us, or either of us, and to __________________________________ (name of minor), for any physical injury or death that results, directly or indirectly from the use (accidental or otherwise) of either of the ponds located on said property. We further agree to indemnify, save and hold Releasees harmless from any loss, liability, attorneys ’ fees, damage, or costs that Releasees (or any of them) may incur (accidental or otherwise) arising out of or related to the use of either of the ponds located on said property by the undersigned and/or our Child, whether caused by the negligence of the Releasees or otherwise. Both of the undersigned Tenants and I fully understand that the use of said ponds involves risks and dangers of serious bodily injury, including death (Risks) and we understand that use of ponds and surrounding area will not be supervised by any of Releasees, and we fully accept and assume all such risks and all responsibility for losses, costs, and damages either we or __________________________________ (name of minor ), incur as a result of use said ponds. This Agreement shall be governed by the laws of the State of ____________. Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
