What a Remote Working Agreement Is and When It Applies

A Remote Working Agreement is a written contract that sets expectations, responsibilities, and logistics for employees performing work outside the employer’s primary office. It records the parties, work location, schedule, equipment and data security rules, expense allocation, and termination or review procedures. The agreement clarifies whether the remote role is temporary, hybrid, or permanent and helps both sides document consent to electronic records and signatures under U.S. law. Well-drafted agreements reduce disputes about pay, tax nexus, equipment ownership, and regulatory compliance while creating a clear operational framework for remote work.

Why a Remote Working Agreement Matters

A written agreement reduces ambiguity about responsibilities, expense reimbursement, tax and benefits implications, and security controls. It documents the parties’ consent to electronic execution under federal and state law and creates an enforceable record of the work arrangement.

Why a Remote Working Agreement Matters

Who Typically Uses a Remote Working Agreement

Use the agreement when shifting roles to remote status, onboarding remote hires, approving temporary work-from-home arrangements, or when state-specific rules could affect payroll, taxes, or reimbursement obligations.

  • Human resources teams standardize policies and track authorizations for payroll, benefits, and expense reimbursement.
  • Managers document role expectations, schedules, and performance measures for remote staff.
  • Individual employees acknowledge work location, equipment responsibility, and confidentiality obligations.

Signatory Roles and Typical Approvers

Employee

The remote worker signs to accept the terms, confirm work location, and consent to electronic records. Signature binds the employee to security, equipment, and schedule obligations and documents acceptance of any reimbursement terms.

Employer Representative

An HR manager or authorized company officer signs on behalf of the employer to confirm position changes, approve expense policies, and accept liability allocations. This signer should be listed with title and authority to bind the employer.

Essential Clauses to Include in the Agreement

A professional Remote Working Agreement should be concise but cover the full operational, legal, and security picture so both parties know expectations and remedies.

Scope of Work

Define duties, reporting relationships, work hours, and whether the role is remote, hybrid, or temporary, including any periodic on-site requirements.

Work Location

Specify primary remote address for payroll, tax, and benefits considerations and explain who may change the location and how notice is given.

Equipment and Access

List employer-provided equipment, ownership, maintenance responsibilities, acceptable personal device use, and return procedures at termination.

Expense Reimbursement

State what expenses the employer will reimburse, how to submit claims, and reference any applicable state law or company policy regarding reimbursements.

Information Security

Require security practices, VPN or encryption use, password policies, and reporting procedures for breaches or lost devices.

Termination and Review

Describe notice periods, conditions for revoking remote privileges, annual review cadence, and dispute resolution mechanisms.

Key Data Fields the Agreement Must Capture

Employee Name: Full legal name
Remote Address: Street, city, state, ZIP
Job Title: Official position name
Effective Date: MM/DD/YYYY

  • 02
Internal Review: Have HR and legal review for tax and compliance.
  • 03
Employee Acceptance: Send to employee for signature and date.
  • 04
Record and Store: Save executed copy in secure HR records.

  • File Formats: PDF, DOCX, or HTML supported
  • Integrations: Connects with HR and cloud storage
  • Authentication: Email, SMS, or advanced methods

Where Signed Agreements Should Be Sent and Filed

Route the executed agreement to HR, payroll, and the employee’s personnel file to maintain a single source of truth and ensure operational updates.

  • HR Records: Store executed PDF in employee file
  • Payroll: Submit changes before the next pay run
  • Manager: Notify direct manager of approved terms
  • IT/Security: Log equipment and access requirements

Typical Timelines and Processing Expectations

Set clear internal deadlines to avoid payroll or compliance gaps when a remote arrangement is authorized or changed.

Employee Return Deadline:

Employee should sign within 7 days

Payroll Update:

Submit address or tax changes before next pay period

Equipment Inventory:

Record items within 14 days of issue

Annual Review:

Review arrangement once per year

Common Preparation Mistakes to Avoid

  • Failing to identify the employee’s remote work address, which can create tax and payroll misclassification issues.
  • Leaving reimbursement terms vague and then disputing whether equipment or utilities are employer obligations.
  • Neglecting security clauses that require VPN access and device encryption, increasing breach risk.
  • Not recording electronic consent for digital signatures, which can complicate enforceability under ESIGN.

Key Risks and Legal Consequences if Done Incorrectly

Tax Nexus Risk: Establishing employee presence in another state can create corporate tax obligations
I-9 Violations: Failure to maintain I-9 records risks penalties under 8 CFR §274a.2
Wage/Hour Exposure: Misclassifying hours or failing to track FLSA hours violates 29 CFR §516.5
Information Security: Data breaches can trigger HIPAA obligations for covered entities
Tax Reporting Penalties: Incorrect forms or TIN mismatches can trigger IRC §6721 penalties
Enforceability Issues: Missing consent or retention may undermine ESIGN validity (15 U.S.C. ch. 96)
