Common Mistakes That Cause Delays or Disputes

  • Incomplete scope descriptions lead to disputes, change omissions, and pay disagreements; include detailed tasks, locations, and cross-references to original contract clauses to reduce ambiguity.
  • Missing effective dates or conflicting timelines create schedule disputes; always state when the modification takes effect and revise milestone dates clearly to avoid overlap.
  • Vague cost language such as "approximately" or "additional" allows billing disagreements; itemize labor, materials, taxes, and allowances with fixed amounts where possible.
  • Failing to get signatures from authorized representatives or omitting authority lines can render a modification unenforceable in disputes or audits.

Penalties and Risks of an Incorrect or Missing Modification

Voidable Modification: Missing authorized signature
Billing disputes: Unspecified costs trigger rejections
Permit Violations: Work without permit risks fines
Contractor Claims: Claims for extra time or costs
