This Rent to Own Agreement (the "Agreement") is entered into as of by and between the Owner/Optionor (Seller/Landlord) and the Resident/Optionee (Buyer/Tenant) identified below.

Financial Terms

Application of Option Consideration and Rent Credits: Option consideration and any monthly rent credits specified above shall be applied to the Purchase Price at Closing if Buyer properly and timely exercises the Option pursuant to Section titled "Option to Purchase." If Buyer fails to timely exercise the Option, Owner shall retain the option consideration and any credited amounts as liquidated damages, not as a penalty, except as otherwise required by applicable law.

Option to Purchase

Grant of Option: Owner hereby grants to Resident an exclusive, irrevocable option to purchase the Property upon the terms set forth in this Agreement. The Option Period shall be months beginning on the Lease Term Commencing date.

Exercise of Option: To exercise the Option, Buyer must deliver written notice of exercise to Owner at least days prior to the desired Closing Date. Notice shall be delivered to the addresses for notice listed below by personal delivery, certified mail with return receipt requested, or other method agreed in writing by the Parties.

Inspections, Condition & Disclosures

Buyer has the right to inspect the Property during the Option Period. Any inspection objections must be delivered in writing to Owner within days after inspection. Owner shall disclose known material defects as required by law.

Maintenance, Repairs & Insurance

Tenant shall maintain the interior of the Property in a clean and safe condition and shall be responsible for routine maintenance and repairs costing less than $ per repair. Owner shall be responsible for major structural repairs unless damage results from Tenant's negligence or misuse.

Insurance: Owner shall maintain property insurance on the structure. Tenant is required to maintain renter's liability insurance in an amount not less than $ and provide proof of coverage upon request.

Utilities, Taxes & HOA

Utilities: Tenant shall be responsible for payment of utilities as follows:

Property Taxes and HOA Fees shall be prorated and allocated between Owner and Buyer at Closing as required by custom and applicable law unless otherwise agreed in writing.

Default and Remedies

Default: If Tenant fails to pay rent or otherwise breaches a material term of this Agreement, Owner shall provide written notice of breach and Tenant shall have days to cure. If Tenant does not cure within the cure period, Owner may pursue remedies set forth in this Agreement and by law, including termination and eviction.

Failure to exercise the Option in accordance with the terms of this Agreement shall constitute a breach and shall result in forfeiture of the option consideration and any rent credits as set forth herein.

Closing

Closing Date: Subject to timely exercise of the Option and satisfaction of contingencies, the Closing shall occur on or before at a mutually agreed closing agent or location.

At Closing, the option consideration and any applicable rent credits will be credited to Buyer toward the Purchase Price. Buyer is responsible for obtaining financing; Owner will cooperate in good faith in the closing process.

Assignment, Subletting & Transfer

Tenant shall not assign this Agreement or sublet the Property without Owner's prior written consent, which shall not be unreasonably withheld. Owner may not transfer Owner's interest in the Property without providing Buyer written notice; a transferee shall assume Owner's obligations upon transfer.

Governing Law & Miscellaneous

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to its conflict of laws principles.

Entire Agreement: This Agreement, together with any addenda or exhibits executed by the Parties, constitutes the entire agreement between the Parties with respect to the subject matter and supersedes all prior agreements and understandings. Any amendment must be in writing and signed by both Parties.

Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment

Both Parties acknowledge that they have read and understand the terms of this Agreement, have had an opportunity to seek independent advice, and enter into this Agreement voluntarily.
