RENT-TO-OWN REAL ESTATE AGREEMENT

This Rent-to-Own Real Estate Agreement ("Agreement") is entered into between the parties identified below for the lease with option to purchase of the Property described herein. The parties hereby agree as follows.

If Tenant defaults in the payment of rent or other material obligations and fails to cure within any applicable notice and cure period required by law, Landlord may pursue available remedies including termination of the lease, retention of option consideration as liquidated damages to the extent permitted by law, eviction, and pursuit of monetary damages. If Landlord defaults in a manner that materially impairs Tenant's rights and fails to cure within a reasonable period after written notice, Tenant may seek specific performance of the purchase option if the option remains exercisable or pursue other remedies at law or in equity.

CLOSING; ALLOCATION OF COSTS

At closing, customary prorations shall apply for taxes, assessments, rents and utilities. Buyer shall be responsible for lender and title costs associated with obtaining financing, unless otherwise agreed in writing. Seller shall deliver good and marketable title free of undisclosed liens, subject to permitted exceptions listed in writing prior to closing.
