Any utilities not regularly metered or separately billed shall be prorated and billed to Tenant as set forth in a separate written billing or attachment to these terms.

Maintenance, Repairs and Alterations

Landlord shall maintain structural components, major systems (heating, plumbing, electrical) and common areas in compliance with applicable habitability standards. Tenant shall promptly notify Landlord of needed repairs and shall keep the Premises clean and free of nuisances. Tenant shall be responsible for repair of damage caused by Tenant or Tenant’s guests beyond reasonable wear and tear.

No permanent alteration shall be made without prior written consent of Landlord. Any approved improvements become property of Landlord unless otherwise agreed in writing.

Pets and Smoking

Insurance and Liability

Tenant is advised and recommended to obtain renters' insurance for personal property and liability. Landlord's insurance does not cover Tenant's personal property. Tenant shall be responsible for claims arising from Tenant's negligence or willful misconduct.

Landlord or Landlord's agents may enter the Premises upon reasonable notice for inspection, repairs, or to show the Premises to prospective tenants or purchasers, except in emergencies where no notice is required. Notice periods and permissible entry times shall comply with applicable law.

Default, Remedies and Termination

Tenant's failure to pay rent when due, abandonment of the Premises, or material breach of any covenant shall constitute default. Upon default Landlord may pursue lawful remedies including termination, possession, damages, and recovery of costs and attorneys' fees where permitted. Tenant may cure certain defaults within any statutory cure period where applicable; otherwise Landlord's notice and remedies as provided by law and this agreement shall apply.

Early Termination: Unless otherwise agreed in writing, early termination by Tenant requires written notice and may result in liability for rent through re-letting and reasonable re-letting costs. Landlord shall mitigate damages.

Governing Law and Entire Agreement

These Rental Letting Terms shall be governed by the laws of the state in which the Premises are located. This document, together with any signed addenda and move-in inventory, constitutes the entire agreement between Landlord and Tenant regarding the letting of the Premises and supersedes prior oral or written agreements.

Additional Provisions

Attorneys' Fees: The prevailing party in any action to enforce this agreement shall be entitled to recover reasonable attorneys' fees and costs to the extent permitted by law.

Severability: If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
