RENTAL PROPERTY OCCUPIED UNIT INSTRUCTIONS

Parties

This Instruction Agreement is entered into between Owner Name: (referred to herein as "Owner") and Provider Name: (referred to herein as "Provider").

WHEREAS

WHEREAS, Owner is the lawful owner or manager of the rental property identified below and occupies or leases certain units to tenants; and

WHEREAS, Provider is engaged to perform services, maintenance, repairs, inspections, or other specified work in units that are currently occupied by tenants; and

WHEREAS, the Parties desire to set forth instructions, responsibilities, scheduling, tenant notification procedures, and liability allocation with respect to work performed in occupied units.

Scope of Work

Provider shall perform the work described below in occupied rental units in a manner that minimizes disruption to tenants, preserves tenant privacy, and complies with applicable habitability standards and local tenant-protection laws. Provider shall be responsible for obtaining all permits and complying with code requirements relating to the Scope of Work.

Occupant Notification and Access Procedures

Provider shall give occupants advance written or printed notice at least days prior to non-emergency entry, unless a shorter period is permitted by local law. Owner shall confirm occupant consent requirements: Consent Required Yes

For emergency access, Provider may enter without prior notice to address imminent threats to life or property; Provider will notify Owner and occupant as soon as practicable following emergency entry.

Payment Terms

Owner shall pay Provider for services performed under this Instruction Agreement in accordance with the following terms.

Either Party may terminate this Agreement for material breach if the breaching Party fails to cure within days after written notice. Owner may also terminate for convenience upon payment of Provider's documented costs and reasonable demobilization charges.

Liability, Indemnification, and Insurance

Provider shall perform work in a workmanlike manner and shall maintain, at Provider's expense, insurance customary for the industry including commercial general liability covering bodily injury and property damage. Provider shall indemnify, defend and hold Owner harmless from claims, damages or losses caused by Provider's negligence or willful misconduct, except to the extent caused by Owner's negligence.

Confidentiality

Provider and Owner acknowledge that information concerning tenants, unit conditions, tenant complaints, and account information is confidential. Provider shall not disclose tenant personal information or confidential records obtained in the course of performing services except as required by law or with Owner's prior written consent. Provider will use confidential information only for the performance of obligations under this Agreement.

Compliance with Laws; Lead Paint and Safety

Provider shall comply with all federal, state and local laws and regulations applicable to work at occupied residential properties, including but not limited to laws concerning hazardous materials, lead-based paint disclosures and abatement procedures, worker safety, and tenant protection statutes. Provider shall promptly notify Owner if suspect hazardous conditions are discovered and shall not proceed with work that may exacerbate hazards without Owner's written direction.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to conflict of law principles.

Entire Agreement

This document, together with any attachments executed by the Parties, constitutes the entire agreement between Owner and Provider relating to work in occupied units and supersedes all prior negotiations, representations, and agreements, whether written or oral. Any amendment or modification must be in writing and signed by both Parties.

Owner acknowledges responsibility to coordinate with tenants as required by applicable law. Provider acknowledges that interference with tenant quiet enjoyment shall be minimized and remediated where caused by Provider's activities.
