RENTAL PROPERTY WAIVER

This Rental Property Waiver (the "Waiver") is made effective as of by and between Landlord: whose address is , and Tenant: (collectively, the "Parties").

Whereas Tenant intends to take possession of the Property identified above and Landlord agrees to permit such possession subject to the terms of this Waiver; and

Except for obligations expressly set forth in any written lease between the Parties, Tenant hereby knowingly and voluntarily waives any and all claims, demands, causes of action, liabilities, and damages against Landlord, Landlord's agents and employees, arising from or related to pre-existing physical conditions of the Property, including but not limited to defects, nuisances, or physical damage discovered or discoverable at the time of possession, provided that this waiver shall not extend to claims arising from Landlord's gross negligence or willful misconduct.

3. Assumption of Risk. Tenant acknowledges that certain conditions may pose a hazard and accepts all ordinary risks associated with the Property's current condition. Tenant agrees to take reasonable precautions for personal safety and the safety of Tenant's invitees.

4. Indemnity. Tenant shall indemnify, defend and hold harmless Landlord from and against any loss, cost, expense, liability or claim (including reasonable attorneys' fees) arising from Tenant's use or occupancy of the Property, Tenant's breach of this Waiver, or the negligence or willful acts of Tenant or Tenant's guests, except to the extent such loss is caused by Landlord's gross negligence or willful misconduct.

If Tenant breaches any material term of this Waiver or of any related lease, Landlord may pursue all remedies available at law or equity, including termination of tenancy, damages, and costs of collection including reasonable attorneys' fees where permitted by law.

This Waiver constitutes the entire agreement between the Parties with respect to the subject matter herein and supersedes any prior oral or written understandings. No modification of this Waiver is valid unless in writing and signed by both Parties.

Governing Law: This Waiver shall be governed by and construed in accordance with the laws of the state in which the Property is located.

Severability: If any provision of this Waiver is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Acknowledgment

Tenant acknowledges that Tenant has read this Waiver, understands its terms, and executes it voluntarily and with full knowledge of its legal effect. Tenant further acknowledges receipt of any required federal or state disclosure documents at or before the time of signing.
