RENTAL STAY AGREEMENT

This Rental Stay Agreement (the Agreement) is made between Landlord/Host Name: and Guest/Occupant Name: .

WHEREAS, Landlord/Host is the owner or lawful manager of the residential premises located at: (the Premises); and

WHEREAS, Guest/Occupant desires to occupy the Premises for temporary lodging under the terms and conditions set forth in this Agreement; and

SCOPE OF STAY

PAYMENT TERMS

Payments not received by the due date are subject to the Late Payment Fee stated above and shall accrue interest at the rate specified if not cured within seven (7) days. Landlord/Host may withhold return of the Security Deposit for unpaid sums, repairs, or extraordinary cleaning.

Either party may terminate this Agreement for material breach by the other party if the breaching party fails to cure the breach within the notice period specified above. Guest/Occupant shall promptly notify Landlord/Host of any damage or unsafe condition. Guest/Occupant is liable for damage caused by Guest/Occupant or their invitees beyond ordinary wear and tear. Landlord/Host may apply Security Deposit toward repairs and unpaid balances. Guest/Occupant is encouraged to maintain personal insurance for liability and personal property; Landlord/Host's insurance does not cover Guest/Occupant's belongings.

CONFIDENTIALITY

The parties agree that information reasonably identified as confidential and obtained in connection with the stay, including access codes, security procedures, and personal contact information, shall not be disclosed to third parties except as required by law or to agents performing obligations under this Agreement. Confidential information does not include information that becomes public through no fault of the receiving party.

INDEMNITY AND LIABILITY

Guest/Occupant shall indemnify, defend, and hold harmless Landlord/Host and their agents from and against any claims, liabilities, damages, and expenses arising from Guest/Occupant's use of the Premises, except to the extent caused by Landlord/Host's gross negligence or willful misconduct. Liability for incidental or consequential damages is expressly disclaimed to the fullest extent permitted by law.

GOVERNING LAW; ENTIRE AGREEMENT

This Agreement shall be governed by and construed in accordance with the laws of the state of , without regard to conflict of law principles. This Agreement constitutes the entire agreement between the parties concerning the subject matter herein and supersedes all prior agreements, understandings, and representations, whether oral or written. Any amendment must be in writing and signed by both parties.

MISCELLANEOUS
