Maintenance, Repairs and Alterations

Landlord is responsible for maintaining habitable premises and performing necessary repairs except for damage caused by Boarder. Boarder shall promptly notify Landlord of needed repairs. Boarder shall not make alterations, paint, or install fixtures without prior written consent of Landlord.

Entry and Inspection

Landlord may enter the premises for repairs, inspections, or in an emergency. Except in an emergency, Landlord will provide reasonable notice prior to entry and shall attempt to schedule entry at reasonable hours. Boarder shall not unreasonably withhold consent to entry for legitimate purposes.

Termination and Notice

Either party may terminate this Agreement by providing written notice of termination. Unless otherwise agreed, a minimum notice period of   days is required. Early termination by Boarder may result in forfeiture of all or part of the holding deposit as liquidated damages as provided herein.

Default and Remedies

Material breach by either party shall entitle the non-breaching party to pursue available remedies including termination, recovery of damages, and costs of enforcement. Landlord may pursue eviction or license revocation procedures where permitted by law for nonpayment or other breaches. Boarder remains liable for rent and other amounts due through lawful termination.

Insurance and Indemnity

Boarder is strongly advised to maintain personal property and liability insurance. Boarder indemnifies and holds Landlord harmless from claims arising from Boarder's negligent acts or willful misconduct, except to the extent caused by Landlord's negligence.

Governing Law: This Agreement shall be governed by the laws of the state in which the Property is located. Venue for disputes shall be in the appropriate court of that jurisdiction. The parties agree that this instrument constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior negotiations and agreements, whether written or oral.

Severability: If any provision of this Agreement is held invalid, the remainder shall remain in full force and effect. Waiver: Failure to enforce any provision shall not be construed as a waiver of future enforcement.
