Residential Dwelling Agreement

Parties

This Residential Dwelling Agreement (the "Agreement") is entered into as of the date signed below by and between Landlord and Tenant for the lease of the Property described herein.

Property Identification

Term of Lease

The lease term shall commence on , and shall terminate on , unless earlier terminated in accordance with this Agreement.

If Tenant holds over after the expiration of the Term without Landlord's written consent, Tenant shall be deemed a month-to-month tenant at a monthly rent equal to one hundred twenty percent (120%) of the last full monthly rent, subject to all other terms herein.

Rent, Payment and Late Charges

Payments shall be made to Landlord at the Landlord Contact Address or other location designated in writing. Rent not received by Landlord within days after the due date shall incur a late fee of and interest at the rate of per annum on the overdue amount until paid.

Security Deposit and Fees

Security deposit shall be held by Landlord as security for Tenant's performance of obligations. Landlord may deduct for unpaid rent, repairs for damages beyond normal wear and tear, cleaning, and other breaches. An itemized statement of deductions and any remaining deposit shall be delivered to Tenant in accordance with statutory timelines.

Utilities, Services and Appliances

Tenant shall be responsible for payment of the following utilities and services unless otherwise noted:

Maintenance, Repairs, and Entry

Tenant shall keep the Premises clean and sanitary and promptly notify Landlord of any conditions requiring repair. Landlord shall maintain structural, plumbing, electrical and heating systems in good repair and comply with applicable habitability standards. Tenant shall be responsible for repair of damage caused by Tenant's negligence or misuse.

Landlord may enter the Premises upon reasonable notice for inspection, repairs, or to show the Premises to prospective buyers or tenants, except in the case of emergency in which Landlord may enter without prior notice.

Alterations and Improvements

Tenant shall not make alterations, additions, or improvements to the Premises without Landlord's prior written consent. Any authorized fixtures installed by Tenant shall become Landlord's property unless otherwise agreed in writing. Tenant shall be responsible for removal costs and repair of damage caused by removal if removal is requested by Landlord.

Insurance

Tenant is strongly advised to obtain renter's insurance covering personal property, liability, and additional living expenses. Landlord's insurance does not cover Tenant's personal property. Tenant shall maintain liability coverage of at least and provide proof upon request.

Default, Remedies and Termination

If Tenant fails to pay rent or otherwise breaches this Agreement, Landlord may provide written notice of default and pursue all remedies permitted by law, including termination of tenancy, damages, and recovery of costs and attorneys' fees where allowed by law. Tenant shall have any applicable cure period required by statute or as expressly provided in this Agreement.

Upon termination, Tenant shall surrender the Premises in broom clean condition and pay for repair of damages beyond normal wear and tear. Landlord may withhold amounts from the security deposit for unpaid rent, repairs, cleaning, and other permitted charges, with an itemized statement delivered to Tenant.

Assignment and Subletting

Tenant shall not assign this Agreement or sublet the Premises without Landlord's prior written consent, which shall not be unreasonably withheld. Any attempted assignment or sublease without consent shall be void and shall constitute default.

Governing Law; Entire Agreement

This Agreement shall be governed by the laws of the state in which the Property is located. This instrument contains the entire agreement between the parties relating to the Lease and supersedes all prior negotiations, representations or agreements, whether written or oral. Any modification must be in writing and signed by both parties.

Notices shall be in writing and delivered to the addresses below by certified mail, personal delivery, or recognized commercial courier; effective upon receipt by the receiving party.

Move-In Condition and Inventory

Tenant and Landlord shall complete a move-in condition report documenting the condition of the Premises and existing furnishings. That report shall be attached to this Agreement or retained by Landlord and will be controlling for security deposit deductions related to condition at move-out.
