Security Deposit

Security deposit shall be held to secure performance of Tenant's obligations. Landlord may apply deposit to unpaid rent, repair of damage beyond normal wear and tear, and costs to return Premises to condition required by this Agreement. Use, Storage and Prohibited Materials

The Premises shall be used solely for storage of personal property and parking of vehicles incidental to residential use. Tenant shall not use the Premises for living, manufacturing, business operations, or storage of hazardous materials. Prohibited items include, without limitation, gasoline, propane cylinders, explosives, asbestos, or other materials that present a fire or environmental hazard.


Maintenance; Repairs; Alterations

Tenant shall keep the Premises clean and free of debris and shall not permit accumulation of hazardous waste. Tenant shall promptly notify Landlord of any damage or needed repairs. Landlord remains responsible for structural repairs and major systems serving the garage. Tenant shall not make alterations, hangings, or install shelving, locks, or alarm devices without prior written consent of Landlord. Any authorized alteration becomes part of the Premises and may not be removed without Landlord's consent.

Insurance and Indemnity

Tenant is responsible for obtaining and maintaining renter's insurance or other insurance covering Tenant's personal property stored in the Premises and liability arising from Tenant's use. Landlord shall not be liable for loss, theft, damage, or injury to Tenant's property except to the extent caused by Landlord's gross negligence or willful misconduct. Tenant shall indemnify and hold Landlord harmless from claims connected to Tenant's use or occupancy of the Premises.

Access; Keys; Security

Tenant shall not change locks or access devices without Landlord's prior written consent. Landlord or Landlord's agents may enter the Premises in case of emergency or to make necessary repairs, or as otherwise required by law, with reasonable notice to Tenant except in emergency. Tenant must return all keys and access devices to Landlord upon termination of this Agreement.

Default; Remedies

If Tenant fails to pay rent or otherwise breaches this Agreement, Landlord may pursue available remedies under this Agreement and applicable law, including termination of tenancy, recovery of unpaid rent, and costs of repair. Tenant shall be liable for collection costs, court costs, and reasonable attorneys' fees incurred by Landlord in enforcing Tenant's obligations if permitted by law.

Surrender; Abandonment

Upon expiration or termination of this Agreement Tenant shall remove all personal property and return the Premises in clean condition, ordinary wear and tear excepted. Abandonment of stored property may subject Tenant to liability for storage and disposal costs as provided by law.

All notices required or permitted under this Agreement shall be in writing and delivered to the addresses set forth above or to such other address as a party designates in writing. Notices delivered personally shall be deemed given upon delivery; mailed notices shall be deemed given on the date of deposit with postage prepaid.

Governing Law; Entire Agreement

This Agreement shall be governed by and construed in accordance with the laws of the state where the Premises are located. This Agreement, together with any written attachments signed by the parties, constitutes the entire agreement between the parties concerning the Premises and supersedes all prior representations and agreements, whether written or oral.

Miscellaneous

No waiver by either party of any breach shall be deemed a waiver of subsequent breaches. If any provision of this Agreement is held invalid, the remainder shall continue in full force. Tenant may not assign this Agreement or sublet the Premises without prior written consent of Landlord.
