Lease Terms (Summary)

Guaranty Provisions

For good and valuable consideration, the receipt and sufficiency of which are acknowledged, the undersigned Guarantor unconditionally and irrevocably guaranties to Landlord the full and punctual payment and performance of all obligations of Tenant under the Lease, including payment of rent, charges, repairs, damages, and any sums required to enforce the Lease, together with interest, costs and attorneys' fees. This guaranty is a continuing guaranty and shall remain in full force and effect until all obligations of Tenant under the Lease have been indefeasibly satisfied.

Guarantor agrees that this guaranty is absolute and unconditional, and Landlord may, without notice to or consent from Guarantor, extend, modify, renew or alter the Lease or advances thereunder, accept partial payments, release or substitute tenants, or otherwise deal with Tenant or the Lease. Guarantor waives presentment, demand, protest, notice of default, notice of nonpayment, and notice of acceptance of this guaranty.

Guarantor expressly waives any rights of subrogation, reimbursement or indemnity against Tenant until Landlord has received full payment and performance of all sums and obligations. Guarantor shall be jointly and severally liable with Tenant. Landlord may enforce this guaranty without first proceeding against Tenant, any other guarantor or any collateral.

Guaranty of payment and performance of all Tenant obligations (default broad guaranty)

Guaranty limited to payment obligations only (no guaranty of Tenant's non-monetary obligations)

Guarantor further agrees to pay all costs and expenses, including reasonable attorneys' fees and court costs, incurred by Landlord in enforcing this guaranty. If any provision of this guaranty is held invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect.

This guaranty shall be governed by and construed in accordance with the laws of the state selected by Landlord below. Guarantor submits to the jurisdiction of the courts in that state for any action or proceeding concerning this guaranty.

Notices

All notices under this guaranty shall be in writing and shall be delivered to the addresses set forth below or to such other address as a party may designate by notice to the other parties in accordance with this paragraph. Delivery by hand, nationally recognized overnight courier, or certified mail, postage prepaid, shall constitute receipt.

Additional Provisions

This guaranty constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements and understandings, whether oral or written. No amendment to this guaranty shall be effective unless in writing and signed by Landlord and Guarantor.

Time is of the essence with respect to all monetary obligations of Tenant and Guarantor hereunder. The failure of Landlord to insist upon strict performance of any term hereof shall not be deemed a waiver of Landlord's rights.

What the Residential Guaranty Lease Pages Are

Residential Guaranty Lease Pages are the sections of a lease package where a guarantor agrees to assume financial and performance obligations of a tenant. These pages typically include guarantor identification, contact and employment information, the scope and duration of the guaranty, recourse provisions, and signature blocks for the guarantor and landlord. They function as a standalone enforceable promise or as an exhibit to a primary lease. Proper completion clarifies liability, speeds approval, and creates a clear record for enforcement or dispute resolution.

Why a Clear Guaranty Page Matters

A well-drafted guaranty reduces ambiguity about who is responsible if rent or damages are unpaid, supports credit checks and underwriting, and helps landlords document enforceable obligations. It also protects guarantors by defining limits, duration, and conditions under which obligations arise.

Why a Clear Guaranty Page Matters

Who typically completes or reviews these pages

Several parties interact with guaranty pages during leasing: landlords, property managers, guarantors, and leasing attorneys.

  • Landlords and Property Managers: Review financial terms, verify guarantor identity, and retain executed copies for enforcement and accounting.
  • Guarantors: Provide personal and financial details, sign to accept liability, and receive a copy for their records and potential legal counsel.
  • Leasing Counsel and Underwriters: Confirm legal language, limit exposure, and ensure the guaranty aligns with state law and underwriting standards.

Primary signers and reviewers

Guarantor

An individual or entity that signs to guarantee tenant obligations. The guarantor should provide full legal name, address, DOB or EIN, employment and financial references, and signature authority documentation where applicable. Accuracy is critical for enforceability and credit verification.

Property Manager

The landlord's agent who collects the guaranty, verifies identification and supporting documents, and files the executed guaranty with the tenant's lease record. The manager documents receipt dates and any required approvals.

Core fields required on guaranty pages

Guarantor Name: Full legal name
Guarantor Address: Street, city, state, ZIP
Identification: Driver's license or EIN
Scope of Guaranty: Unlimited or capped
Effective Date: MM/DD/YYYY
Signature Block: Signature and date

Key risks if the guaranty is incorrect

Unenforceable Guaranty: Missing signatures
Tax Consequences: Incorrect EIN/TIN
Eviction Liability: Guarantor liable for rent
Credit Impact: Reported delinquencies
Delay in Occupancy: Processing delays
Legal Fees: Costly enforcement

Common preparation mistakes to avoid

  • Using initials instead of full signatures or failing to include a dated signature line creates ambiguity about when the guaranty took effect and may invalidate enforcement.
  • Leaving the guaranty amount blank or stating vague limits like 'reasonable amount' can lead to disputes over the guarantor's exposure.
  • Collecting incomplete identification (no government ID or mismatched name) slows verification and can render the document unenforceable.
  • Failing to obtain consent to electronic delivery or to retain an accessible copy of the executed record can interfere with ESIGN compliance and future proof of signing.

Step-by-step: completing the guaranty pages

Follow these four steps to complete and document a residential guaranty accurately.

  • 01
Prepare document: Attach guaranty to lease and confirm governing state.

  • 03

Where to send or file the completed pages
