What the Residential Lease Intent Form Is

The Residential Lease Intent Form records a prospective tenant's intent to lease a specific rental property and outlines preliminary terms such as property address, proposed lease start date, lease term, rent, and any deposit or contingency terms. It is typically non-binding unless the parties state otherwise and can be used to begin negotiations, reserve the unit, or trigger preparation of the formal lease agreement.

Why a Written Lease Intent Matters

A clear lease intent reduces misunderstandings, creates a written record of key terms, and speeds transition to a formal lease. When completed accurately it provides a basis for deposit handling, scheduling move-in, and drafting the final lease.

Why a Written Lease Intent Matters

Who Typically Completes This Form

Use the form to align expectations, confirm deposit amounts and deadlines, and prompt preparation of a binding lease if both parties agree.

  • Landlords and property managers who want an early written record of tenant commitments and deposit terms.
  • Prospective tenants submitting intent to hold or request lease preparation while arranging financing or notice to vacate.
  • Real estate agents and leasing brokers documenting client interest and coordinating paperwork between parties.

Step-by-Step: Complete a Lease Intent Form

Complete this checklist in order to create a clear, usable lease intent that can be converted into a formal lease or serve as an interim agreement.

  • 01
Prepare information: Gather IDs, income proof, and property details before starting.
  • 02
Enter parties: Record landlord and tenant full legal names and contact information.
  • 03
Specify terms: Add dates, rent, deposit, and any contingencies in MM/DD/YYYY format.
  • 04
Sign and distribute: Obtain signatures and provide copies to all parties for records.

Common Preparation Mistakes to Avoid

  • Ambiguous move-in or lease start dates that lead to prorating disputes or overlapping tenant obligations.
  • Incomplete property descriptions (missing unit numbers or parking details) resulting in disagreements about included space.
  • Unclear deposit terms or refund conditions that cause forfeiture disputes during termination or denial of occupancy.
  • Failure to state whether the form is binding, which can lead to contested interpretations during negotiations.

Potential Consequences of an Incorrect Form

Non-binding status: Parties may not be legally obligated
Deposit loss: Forfeiture disputes with unclear conditions
Occupancy delay: Move-in timing may be postponed
Breach claims: Disagreements can trigger litigation
Record gaps: Missing records hinder enforcement
Legal fees: Costs to resolve disputes

Practical Tips for Accurate and Efficient Completion

Follow these best practices to reduce disputes, shorten turnaround times, and ensure the lease intent feeds cleanly into the formal lease.

Be explicit about binding intent
State clearly whether the form is intended to be binding; ambiguous language causes disputes and may require attorney interpretation.
Use consistent dates and formats
Adopt MM/DD/YYYY across the form to avoid misinterpretation and align with background-check timelines and rent prorations.
Attach supporting documents
Include proof of income, ID copies, and any property disclosures as attachments to speed verification and lease preparation.
Preserve an audit trail
Retain signed copies, timestamps, and signer authentication records to support enforceability and defend against claims.

Notarization and Witness Flow (If Required)

Follow this horizontal sequence when a lease intent or related document requires notarization or witness attestation under local rules.

01

Determine Notary Need

Check state or landlord policy to see if notarization is required or recommended.

02

Choose RON or In-Person

Select remote online notarization where legally permitted to save travel and scheduling time.

03

Identity Proofing

Signer must present acceptable ID or pass electronic credentialing for RON.

04

Schedule Notary

Book a session and confirm required documents and witness presence if applicable.

05

Sign in Presence

Sign before the notary or in the recorded RON session to validate acknowledgement.

06

Notary Acknowledgement

Notary completes certificate and records the event per state rules.

07

Record Filing

If the lease must be recorded, submit to the county recorder with required fees.

08

Retain Evidence

Store notarized documents and AV recordings per retention policy.

Primary Signers and Their Roles

Landlord / Owner

The landlord or authorized agent signs to confirm the property is offered on the stated terms. Their signature binds the owner (unless agent authority is limited), and contact details should be included for service of notices.

Prospective Tenant

One or more tenants sign to indicate intent, agree to financial terms, and authorize background or credit checks if the form contains such consent clauses.
