Default, Remedies and Termination

If Tenant fails to pay Rent when due or otherwise materially breaches this Agreement, Landlord may pursue any remedy allowed by law, including termination of tenancy, recovery of possession, and collection of unpaid Rent, damages and reasonable attorneys' fees. Except where a shorter statutory cure period applies, Tenant shall have to cure a monetary default.

Holding over: If Tenant remains in possession after termination, Tenant shall be liable for Rent at a daily rate equal to the monthly Rent divided by 30, and for any damages incurred by Landlord.

Miscellaneous Provisions

This Agreement constitutes the entire agreement between the parties relating to the subject matter and supersedes all prior negotiations and agreements. Any modification must be in writing and signed by both parties. If any provision is held invalid, the remainder shall remain enforceable.
