Seller and Broker Obligations

Seller shall provide Broker access to the property, cooperate with reasonable marketing activities, maintain the property in materially the same condition, and timely deliver any documents reasonably required for sale. Broker shall use commercially reasonable efforts to market the property, present all offers promptly, and comply with applicable laws and MLS rules.

Termination, Holdover and Remedies

Except as otherwise set forth in the Listing Agreement, this Addendum does not terminate the Listing Agreement unless expressly provided. If Seller breaches this Addendum or Listing Agreement, Broker may pursue remedies including recovery of commissions earned under the Listing Agreement, actual damages, and costs of enforcement. If Broker materially breaches obligations, Seller may terminate the Listing Agreement after providing written notice and a reasonable cure period of days.

Governing Law and Entire Agreement

This Addendum is governed by the laws of the state in which the Property is located. This Addendum and the Listing Agreement constitute the entire agreement between the parties with respect to the subject matter hereof and supersede prior oral or written agreements to the extent they conflict.
