RESIDENTIAL LIVING SITUATION

This Residential Living Situation Agreement ("Agreement") is entered into between Host Name: and Resident Name: as of the Effective Date set forth below.

WHEREAS

WHEREAS, Host is the lawful occupant or owner of the Premises located at the address set forth above and has authority to permit short-term or ongoing occupancy; and

WHEREAS, Resident desires to occupy a portion of the Premises under the terms and conditions set forth in this Agreement and Host is willing to permit such occupancy subject to payment and compliance with the rules herein; and

WHEREAS, the parties wish to set forth the rights and obligations of each party concerning occupancy, payment, maintenance, confidentiality, use of common areas, and termination.

SCOPE OF WORK (OCCUPANCY)

The parties agree that the following describes the scope of occupancy and services to be provided. Resident shall occupy only the portion of the Premises described below and shall have the limited use of common areas subject to the house rules and any reasonable restrictions established by Host.

PAYMENT TERMS

Resident agrees to pay the following amounts to Host in consideration for occupancy and any services agreed in this Agreement.

All sums due under this Agreement shall be paid in lawful currency by cash, check, electronic transfer, or other method agreed by the parties. If any payment is more than seven (7) days late, the Late Fee specified above shall be immediately due and payable and interest shall accrue on overdue sums at the rate of one percent (1%) per month or the maximum permitted by law, whichever is less.

TERM AND TERMINATION

This Agreement commences on Start Date: and shall continue until End Date: unless earlier terminated in accordance with this Agreement.

Either party may terminate this Agreement for convenience upon providing the other party written notice as specified above. Host may terminate immediately for material breach including nonpayment, illegal activity, or conduct that creates a safety risk. Resident must vacate the Premises within the notice period unless otherwise agreed in writing.

CONFIDENTIALITY

Resident and Host acknowledge that in the course of the living arrangement they may learn confidential personal or business information of the other party. Each party agrees not to disclose confidential information to third parties and to take reasonable measures to protect such information, except as required by law or with prior written consent. Confidential information does not include information already in the public domain through no fault of the receiving party.

UTILITIES, MAINTENANCE, AND HOUSE RULES

The parties agree as follows regarding utilities and maintenance.

Resident shall keep the premises reasonably clean, promptly notify Host of damage or needed repairs, and not make alterations without Host's prior written consent. Host may enter the occupied areas with reasonable notice for inspection, repairs, or emergency response.

Each party is responsible for obtaining their own personal property and liability insurance. Host is not liable for loss or damage to Resident's personal property except to the extent caused by Host's gross negligence or intentional misconduct. Resident shall indemnify Host for damages caused by Resident's negligence or willful acts.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of without regard to conflict of law principles.

ENTIRE AGREEMENT

This Agreement, including any written attachments executed by the parties, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral. No modification of this Agreement is effective unless in writing and signed by both parties.
