RESIDENTIAL MOVE AGREEMENT

This Residential Move Agreement (the Agreement) is made as of between Client Name: whose address is (hereinafter "Client"), and Mover Name: whose address is (hereinafter "Mover").

RECITALS

WHEREAS, Client desires to engage Mover to provide residential moving services consisting of packing, loading, transporting and unloading household goods from the origin described below to the destination described below on the scheduled move date; and

WHEREAS, Mover is duly licensed, equipped and experienced to provide such services and is willing to perform the services subject to the terms and conditions set forth in this Agreement; and

WHEREAS, both parties desire to set forth their respective rights and obligations in writing.

NOW, THEREFORE

In consideration of the mutual promises contained herein, the parties agree as follows:

1. SERVICES

1.1 Scope. Mover shall provide professional moving services including packing, loading, transporting and unloading household goods as requested by Client. The services shall include handling of the inventory described below and any additional services expressly agreed in writing. Client acknowledges that fragile, hazardous, perishable and irreplaceable items require special handling and that Mover's liability for such items may be limited under this Agreement.

2.1 Scheduled Move Date: The parties anticipate the move to occur on . Approximate pickup time: . Client understands that the scheduled date and time may be adjusted due to factors beyond Mover's control and that Mover will notify Client of reasonable changes.

4.1 Estimate. Mover has provided an estimated total charge to Client. The estimate is based on the inventory and conditions at the time of inspection and is subject to change if actual services differ materially from the estimate.

4.2 Payment Terms. Client shall pay the balance upon completion of unloading at the Destination unless otherwise agreed in writing. If Client fails to pay timely, Mover may charge interest and exercise any lien rights allowed by law.

5. LIABILITY, INSURANCE AND VALUATION

5.1 Limitation of Liability. Except as provided in this Section, Mover's liability for loss or damage to goods shall be limited to the valuation selected below or to the maximum allowed by applicable law if no valuation is selected. Client acknowledges that released valuation provides minimal liability and that higher valuations increase carrier liability and may increase the charge.

5.2 Valuation Selection (select one):
Released Value Protection: Mover's liability is limited to replacement value of lost or damaged items at a rate of $0.60 per pound per article or other minimal statutory limit as applicable.

5.3 Exclusions. Mover shall not be liable for loss or damage resulting from inherent vice, natural deterioration, infestation, war, nuclear incident, or acts of God. Valuable items such as jewelry, cash, negotiable instruments, and certain electronics should be retained by Client or specifically declared and insured in writing.

6. PACKING AND ACCESSORIES

6.1 Packing Services. If Mover provides packing services, such services will be performed with reasonable care. Client shall disclose any fragile or unusually heavy items and shall ensure that all items to be moved are reasonably prepared for transport.

7. ACCESS, PERMITS AND PARKING

7.1 Client Responsibilities. Client shall secure and pay for any necessary permits, parking, elevator reservations or other access requirements. Mover may assess additional charges for delays, long carries or difficult access.

8. CLAIMS, NOTICE AND TIME LIMITS

8.1 Notice of Loss or Damage. Client must inspect goods upon delivery and report in writing any visible loss or damage before Mover departs the Delivery location. For concealed loss or damage, Client must provide written notice to Mover within seven (7) days of delivery. For loss claims, Client must submit a written claim describing the items, value and nature of loss within thirty (30) days of delivery.

9. INDEMNIFICATION

Each party shall indemnify, defend and hold harmless the other party from and against any claims, liabilities, damages or expenses (including reasonable attorneys' fees) to the extent resulting from the indemnifying party's breach of this Agreement, willful misconduct or negligence. This indemnity shall survive termination of this Agreement.

10. LIMITATION OF LIABILITY

Except for willful misconduct or gross negligence, neither party shall be liable for incidental, consequential or punitive damages, including loss of use or lost profits. Mover's aggregate liability under this Agreement shall not exceed the greater of the declared valuation selected in Section 5 or the total charges actually paid by Client for the services giving rise to the claim.

11. NOTICES

All notices required or permitted under this Agreement shall be in writing and delivered by personal delivery, certified mail, or overnight courier to the addresses set forth below or to such other address as the receiving party designates in writing.

12. GOVERNING LAW; ENTIRE AGREEMENT; SEVERABILITY

12.1 Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the state specified by agreement of the parties without regard to conflict of law principles.

12.2 Entire Agreement. This Agreement, including any written attachments or addenda signed by the parties, constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes all prior agreements and understandings, oral or written.

12.3 Severability. If any provision of this Agreement is held invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect and such invalid or unenforceable provision shall be reformed only to the minimum extent necessary to make it enforceable.

13. AMENDMENT; WAIVER; COUNTERPARTS

13.1 Amendment. No amendment or modification of this Agreement shall be effective unless in writing and signed by both parties.

13.2 Waiver. The failure of either party to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.

13.3 Counterparts. This Agreement may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one and the same instrument.
