RESIDENTIAL MOVE OUT AGREEMENT

This Residential Move Out Agreement (the Agreement) is entered into by and between the parties identified below for the property described herein. The parties intend to set forth the terms, conditions, and obligations related to Tenant's move-out, the final inspection, the disposition of the security deposit, and any charges or credits that may apply.

Tenant agrees to vacate and deliver possession of the Property on or before . A final walk-through inspection will be conducted on at approximately .

Tenant shall return all keys, garage openers, and access devices to Landlord on or before move-out. Tenant acknowledges that failure to return keys may result in rekeying charges and deductions from the security deposit.

SECURITY DEPOSIT AND CHARGES

Landlord will provide an itemized statement of any deductions from the security deposit, with supporting receipts and calculations, within days of Tenant vacating the Property. Deductions may include unpaid rent, unpaid utilities, cleaning costs, repair of damage beyond normal wear and tear, and removal/storage of abandoned property.

PROPERTY CONDITION, REPAIRS AND ABANDONED ITEMS

Tenant shall deliver the Property in clean condition and in substantially the same condition as received, reasonable wear and tear excepted. Tenant is responsible for repair of any damage caused by Tenant, Tenant's guests, or invitees. Landlord may obtain repair estimates and records and apply reasonable charges against the security deposit.

If Tenant leaves personal property at the Property after move-out, Landlord may consider such items abandoned and may dispose of or store such items in accordance with applicable law. Tenant will be responsible for costs of removal, storage, and disposal.

UTILITIES AND FINAL ACCOUNTING

Tenant shall terminate or transfer utilities effective on the move-out date and shall pay all utility charges through the date of move-out. Final meter readings (if applicable) shall be recorded at move-out: Electricity , Gas , Water .

The following disclosures are provided by Landlord to Tenant regarding the condition of the Property to the best of Landlord's knowledge. Tenant acknowledges receipt and review of these disclosures.

DEFAULT, REMEDIES AND MISCELLANEOUS

If Tenant fails to vacate on the agreed move-out date or fails to comply with any material obligation under this Agreement, Landlord may pursue all remedies available under the rental agreement and applicable law, including but not limited to legal action for possession and recovery of damages and costs of collection, including reasonable attorneys' fees.

This Agreement constitutes the entire agreement between the parties with respect to the move-out matters addressed herein and supersedes any prior move-out arrangements, whether oral or written. Any modification to this Agreement must be in writing and signed by both parties.

This Agreement shall be governed by the laws of the state in which the Property is located. If any provision of this Agreement is held invalid, the remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENTS

Tenant acknowledges that Tenant has inspected the Property and the condition report and agrees to the procedures set forth herein for final accounting and disposition of the security deposit. Tenant further acknowledges that any willful misrepresentation of the move-out condition may be used as the basis for collection of damages.
