What the Residential No Smoking Addendum Is

A Residential No Smoking Addendum is a lease attachment that records a landlord’s smoking policy for a particular rental unit or property. It modifies the primary lease to prohibit smoking in specified areas, defines permitted areas (if any), assigns responsibility for violations and remediation, and becomes legally binding when all lease parties sign. The addendum can cover cigarettes, e-cigarettes, vaping, marijuana, and other smoke-producing activities, and should be clear about enforcement, damages, and how disputes will be handled.

Why landlords and tenants use this addendum

The addendum clarifies expectations, reduces secondhand smoke conflicts, and preserves property condition by assigning remediation costs. It supports consistent enforcement across units and creates a written record that can be enforced as part of the lease when properly executed under applicable electronic signature law.

Why landlords and tenants use this addendum

Typical parties who complete the addendum

Landlords, property managers and tenants commonly use this addendum alongside residential leases to set smoking rules and enforcement terms before occupancy.

  • Independent landlords and owners: Use to add unit-specific rules and document tenant agreement to smoking restrictions.
  • Property management companies: Apply consistently across portfolios to reduce unit turnover and remediation costs.
  • Tenants and household members: Sign to acknowledge permitted areas, penalties, and remediation responsibilities.

Signed addenda should be stored with the original lease and retained according to recordkeeping best practices for the jurisdiction and property type.

Who signs and in what role

Landlord / Manager

The individual or company holding authority to amend the lease. Their signature binds enforcement actions and authorizes remediation charges under the lease terms.

Tenant / Occupant

The tenant (and any co-tenant) signs to acknowledge and accept the smoking restrictions, potential fines, and responsibility for guest behavior under the lease.

Core elements to include in a professional addendum

A complete Residential No Smoking Addendum should be precise about scope, definitions, enforcement, and remedies so all parties understand obligations and consequences.

Scope

Specify which spaces are covered (unit interior, balconies, yards, common areas) and whether smoking is allowed in any designated outdoor areas.

Definitions

Define 'smoking' to include tobacco, e-cigarettes, vaping, marijuana, and other devices to avoid ambiguity and enforcement disputes.

Effective Date

State when the addendum takes effect and whether it applies immediately or at lease renewal to clarify timing for compliance and enforcement.

Penalties

Describe penalties (fines, cure periods, lease termination) and how violations are documented and charged to the tenant for remediation.

Remediation

Outline landlord’s rights to repair damage, calculate remediation costs, and apply charges to the tenant’s security deposit or account.

Conflict Resolution

Include notice and cure procedures, escalation steps, and whether disputes follow mediation, small claims, or other specified processes.

Step-by-step: completing and executing the addendum

Follow these steps to create a clear, enforceable addendum and ensure all parties receive a signed copy for their records.

  • 01
Draft the addendum: Attach to the lease and include scope and definitions.
  • 02
Review state rules: Confirm local requirements for notarization or witness rules.
  • 03
Obtain signatures: Collect landlord and tenant signatures and dates.
  • 04
Distribute copies: Provide signed copies to all parties and retain originals.

Typical routing and filing process

Understand who receives the document and where signed copies should be stored to maintain an auditable record and enable enforcement.

  • Prepare: Attach the addendum to the lease and verify property details.
  • Sign: Collect landlord and tenant signatures, either in person or electronically.
  • Record: Add the signed addendum to the tenant file and lease record.
  • Share: Provide signed copies to each party and maintain a master copy.

Configuring an online workflow for this addendum

Set up the document and signer steps to reduce errors and speed execution when using an eSignature platform.

Common preparation mistakes to avoid

  • Using vague language that fails to define 'smoking' and permitted devices leads to enforcement disputes and inconsistent application.
  • Not aligning tenant names and signatures with the primary lease can create identification problems when enforcing remedies.
  • Failing to check state or local ordinances that restrict eviction or modification of lease terms can render provisions unenforceable.
  • Neglecting to provide signed copies to all parties or to retain a secure master copy complicates proof of agreement.

Real-world use scenarios

Two representative situations illustrate how landlords and managers use a no smoking addendum to protect property and clarify obligations.

Small Landlord Case

A single-property owner wants to ban indoor vaping to avoid residue issues

  • Tenant initialed the addendum at lease signing
  • After a guest-smoke incident, documented remediation charges matched the addendum terms and reduced landlord loss.

Large Portfolio Manager

A management company applies a standardized addendum across units to reduce turnover costs

  • Addendum signed electronically during renewal
  • Centralized digital records sped up enforcement and billing for remediation across several properties.

Supporting documents commonly attached

Attach supplementary materials to make the addendum enforceable and practical in operation.

Lease Exhibit

Attach the addendum as an exhibit to the lease and reference it in the main lease body so the addendum is incorporated by reference and clearly part of the tenant agreement.

Inspection Report

A pre-occupancy inspection report documents the unit condition before the smoking restriction takes effect and provides baseline evidence for remediation claims if needed.

Remediation Estimate

Provide an example cost schedule for cleaning or repair to clarify potential tenant charges and reduce disputes over remediation amounts.

Acknowledgement Receipt

A signed receipt or confirmation page that the tenant received and reviewed the addendum can help demonstrate notice and consent.

Practical tips for accurate and enforceable addenda

Applying consistent drafting and administrative controls reduces ambiguity and enforcement friction across properties.

Use clear, specific language
Define terms such as 'smoking,' list banned devices and substances, and specify exact locations covered to avoid interpretive disputes and inconsistent enforcement.
Keep records centralized
Store signed addenda with the lease in a centralized system that supports audit trails and easy retrieval in case of disputes or when preparing remediation invoices.
Consider exemptions thoughtfully
Address permitted medical use or service animal exceptions explicitly and consult counsel to ensure compliance with disability accommodation rules.
Use consistent enforcement procedures
Document notice, cure periods, fine schedules, and remediation steps in writing and apply them uniformly to avoid claims of selective enforcement.

Timing considerations and expected processing steps

Certain timing elements affect enforcement and recordkeeping; be deliberate about effective dates, cure periods, and distribution timing.

Effective Date Entry:

Set an effective date (MM/DD/YYYY) aligned with lease start or renewal.

Signature Deadlines:

Obtain signatures before occupancy or as part of the renewal process to avoid gaps in enforceability.

Notice and Cure Periods:

Specify the number of days for tenant cure before fines or termination options.

Distribution Timing:

Provide signed copies to all parties promptly after execution.

Record Retention:

Retain the signed addendum per your record retention policy and applicable law.
