What the Residential Non-Smoking Addendum Is

A Residential Non-Smoking Addendum is a written amendment to a lease that establishes smoking-related rules for a rental unit and common areas. It defines prohibited smoking activities, specifies the space and substances covered, sets tenant and guest responsibilities, and explains remedies for violations. The addendum becomes part of the lease once signed by landlord and tenant, and it can include remediation costs, cleaning requirements, and procedures for notice and cure. Landlords use it to reduce health risks, limit property damage, and clarify enforcement steps.

Why a Clear Non-Smoking Addendum Matters

A precise addendum reduces disputes by documenting expectations, loss allocation, and enforcement steps. It protects property condition, clarifies tenant obligations, and supports consistent application of house rules while enabling evidence-based remedies for violations.

Why a Clear Non-Smoking Addendum Matters

Who Typically Prepares and Signs This Addendum

The addendum is commonly used by property owners and managers as an amendment to an existing residential lease.

  • Landlords and property managers: add enforceable restrictions and recovery remedies for smoke damage.
  • Tenants: acknowledge rules, remediation obligations, and potential lease consequences for violations.
  • Co-signers and guarantors: confirm financial responsibility for remediation or lease termination costs.

Tenants, co-signers, and authorized property agents review and sign; legal review may be appropriate for multi-family or subsidized properties.

Core Elements to Include in a Professional Addendum

A complete addendum states parties, scope, prohibited acts, enforcement, remedies, and effective dates to create an enforceable contract amendment.

Parties

Full legal names for landlord and tenant, plus mailing addresses and contact information to ensure clear attribution and service ability.

Premises

Exact unit designation, building address, and any common areas included, so the spatial scope of the smoking restriction is legally definite.

Smoking Definition

Prohibited Activities

List actions that breach the addendum such as indoor smoking, balcony use, indoor vaping, marijuana combustion, and use by guests.

Remedies

Specify cure periods, cleaning/repair cost allocation, lease termination triggers, and fines or mitigation procedures for violations.

Effective Term

Common Preparation Mistakes to Avoid

  • Vague scope language such as 'no smoking inside' without defining balconies or shared spaces causes enforcement ambiguity and tenant disputes.
  • Failing to state the effective date or cure period can prevent timely enforcement and complicate damage recovery.
  • Omitting a signature line for all adult occupants or authorized guarantors may make the addendum unenforceable against unnamed residents.
  • Not retaining signed copies or missing an audit trail for electronic signatures weakens proof of consent in disputes.

Potential Consequences of an Incorrect or Missing Addendum

Lease Voidance: Weak or unsigned addenda may be unenforceable
Cleanup Costs: Tenant liable for remediation expenses
Legal Disputes: Litigation or small-claims suits
Insurance Impact: Higher premiums or denied claims
Health Liability: Third-party exposure claims
Loss of Rent: Unit downtime during remediation
