7. Insurance, Liability and Indemnification

Tenant shall maintain automobile liability insurance and any additional liability insurance required by Landlord. Tenant's insurance shall be primary for claims arising from Tenant's use of the parking space. Landlord is not responsible for theft, damage, fire, vandalism, or personal injury except to the extent caused by Landlord's gross negligence or willful misconduct. Tenant agrees to indemnify and hold Landlord harmless from claims arising out of Tenant's use of the parking space, including attorney fees and costs incurred in enforcement of this Agreement.

8. Default, Termination and Remedies

Failure to pay rent or other charges when due or violation of material terms constitutes default. Upon default, Landlord may provide written notice to Tenant specifying the breach and a cure period of days (or other period as required by law). If Tenant fails to cure, Landlord may terminate this Agreement, recover possession, collect unpaid rent, damages, and reasonable attorney fees and costs. Remedies are cumulative and do not preclude other relief.

9. Abandoned Vehicles and Towing

Tenant's vehicle is subject to removal or towing at Tenant's expense if stored in violation of this Agreement, improperly parked, constitutes a nuisance, or appears abandoned. Landlord is authorized to remove or arrange for removal after reasonable notice where practicable. Tenant shall be responsible for all towing and storage charges and any damages resulting from improper parking.
