This Residential Pet Policy Agreement (the Agreement) sets forth the terms and conditions under which the Landlord authorizes the presence of one or more household pets in the leased premises occupied by the Tenant. This Agreement is incorporated into and made a part of the Residential Lease dated between the parties identified below.

Rules, Restrictions and Tenant Responsibilities

Tenant agrees to the following rules and acknowledges that noncompliance constitutes breach of the Lease and this Agreement:

  • Pets must be kept under control at all times and shall not cause a nuisance or disturbance to neighbors.
  • Tenant shall immediately remove pet waste from common and private areas and shall not allow pets to urinate or defecate inside the dwelling or in landscaped areas without prompt cleanup.
  • Tenant is solely responsible for all damages caused by pets, including but not limited to chewing, staining, odor remediation, pest treatment, and structural damage.
  • Tenant shall not leave pets unattended for unreasonable periods or tether pets in common areas.

Damage, Cleaning and Repairs

Tenant acknowledges that ordinary wear and tear does not include pet-related damage. Landlord may repair or arrange for repair of any pet-caused damage and charge Tenant for the reasonable cost of such repair. Charges for professional cleaning to remove pet hair, odors, stains, flea or pest infestation will be deducted from the pet security deposit and may exceed the deposit amount, in which case Tenant remains liable for the balance.

Inspections and Access

Landlord or Landlord's agents may inspect the premises in accordance with the Lease. Inspections related to reported pet issues, suspected infestation, or damage may be conducted, with notice as required under the Lease or applicable law.

Default, Remedies and Termination

Tenant's failure to comply with any material provision of this Agreement or the Lease relating to pets shall constitute a default. Remedies available to Landlord include, but are not limited to, immediate removal of pet authorization, assessment of charges for repairs and cleaning, termination of tenancy, and pursuit of any damages permitted by law. No failure to enforce any provision shall constitute a waiver of Landlord's rights.

Indemnification and Liability

Tenant shall indemnify, defend and hold Landlord harmless from any claims, liabilities, losses, costs or expenses (including reasonable attorney fees) arising out of or related to Tenant's pets, including bodily injury to persons or damage to property. Tenant is responsible for obtaining and maintaining any required animal liability insurance.

Tenant affirms that the information provided about each pet is accurate and complete. Tenant acknowledges that Landlord may deny or revoke pet authorization for safety, health, or nuisance reasons consistent with the Lease.
