If Applicant withdraws this Proposal after acceptance by Landlord or fails to timely execute the lease and deliver required funds, Landlord may retain the holding deposit as liquidated damages to the extent permitted by law. If Applicant fails to perform under any lease executed pursuant to this Proposal, Landlord may pursue all remedies available at law or in equity, including acceleration of rent, recovery of possession, damages and reasonable attorneys' fees. Landlord's right to retain deposits or seek remedies is subject to applicable statutory limitations.

Acceptance; Binding Effect

This Proposal is an offer and is binding on Applicant when executed by Applicant and delivered to Landlord. Acceptance by Landlord must be in writing. Until a written lease is executed by both parties, Landlord may withdraw acceptance for good cause including but not limited to adverse credit, references or changes in the condition of the Property. If Landlord accepts this Proposal and both parties execute a lease, such lease will supersede this Proposal except as expressly incorporated into the lease.

Governing Law:

Entire Agreement: This Proposal sets forth the entire understanding between the parties with respect to the subject matter hereof and may be amended only by a writing signed by both parties.

Acknowledgment

By signing below, Applicant acknowledges that all information provided in connection with this Proposal is true and complete to the best of Applicant's knowledge, authorizes Landlord to verify income, rental history, and credit, and understands that any misrepresentation may be grounds for denial of the Proposal or termination of tenancy.
