RESIDENTIAL RENTAL TERMS

This Residential Rental Terms is entered into on Date: by and between Landlord Name: whose address for notices is , and Tenant Name: whose address for notices is .

RECITALS

WHEREAS, Landlord is the lawful owner of the residential premises located at (the "Premises"); and

WHEREAS, Tenant desires to lease the Premises for residential purposes and Landlord agrees to lease the Premises to Tenant upon the terms and conditions set forth herein; and

WHEREAS, the parties intend for these Rental Terms to govern the tenancy and to be incorporated into and constitute the binding agreement between the parties.

NOW THEREFORE, in consideration of the mutual covenants and promises contained herein, Landlord and Tenant agree as follows:

1. PREMISES AND TERM

1.1 Premises. Landlord leases to Tenant and Tenant rents from Landlord the Premises described above.

1.2 Term. The tenancy shall commence on and end on (the "Term"), unless earlier terminated in accordance with these Rental Terms. Holdover by Tenant after expiration shall be a tenancy at sufferance and Tenant shall be liable for rent at a rate equal to one and one-half times the monthly rent unless otherwise agreed in writing.

2. RENT

2.1 Amount and Due Date. Tenant shall pay to Landlord monthly rent in the amount of $ , due on the day of each month at Landlord's notice address or other location designated by Landlord in writing.

2.2 Late Payment and Returned Payment Fees. If rent is not received within days after the due date, Tenant shall pay a late charge of $ , plus interest at the lesser of the maximum lawful rate or % per annum, calculated daily.

2.3 Method of Payment. Rent shall be paid by check, money order, or other method agreed by the parties in writing. Tenant shall not condition payment on Landlord's performance of maintenance or other obligations.

3. SECURITY DEPOSIT

3.1 Amount. Tenant shall deposit with Landlord the sum of $ as security for Tenant's performance of obligations under these Rental Terms.

3.2 Use and Return. Landlord may apply the security deposit to cure Tenant defaults, repair damages (beyond normal wear and tear), and pay unpaid rent or charges. Within the time required by applicable law following termination, Landlord shall provide an itemized statement of deductions and return any remaining deposit to Tenant at Tenant's forwarding address.

4. USE, OCCUPANCY AND SUBLETTING

4.1 Use. The Premises shall be used solely for residential purposes by Tenant and permitted occupants. Tenant shall comply with all laws, ordinances, and lawful rules of any condominium or homeowners' association.

4.2 Occupancy Limit. Occupancy is limited to persons, except as approved in writing by Landlord.

4.3 Assignment and Subletting. Tenant shall not assign this tenancy or sublet any portion of the Premises without Landlord's prior written consent, which shall not be unreasonably withheld. Any permitted assignee or subtenant shall execute a written assumption of Tenant's obligations if required by Landlord.

5. MAINTENANCE, REPAIRS AND ALTERATIONS

5.1 Tenant Obligations. Tenant shall keep the Premises clean and sanitary, promptly notify Landlord of any damage or needed repairs, and be responsible for repair of damage caused by Tenant's negligence or willful acts. Tenant shall not permit hazardous conditions or nuisance activities.

5.2 Landlord Obligations. Landlord shall maintain structural components, major systems, and other items required by law in good repair and shall make repairs within a reasonable time after receiving notice, subject to Tenant's cooperation and access.

5.3 Alterations. Tenant shall not make alterations, additions, or improvements without Landlord's prior written consent. Any permitted alterations shall be completed in a workmanlike manner, and Landlord may require removal and restoration at Tenant's expense upon termination.

6. UTILITIES AND SERVICES

Landlord or Landlord's agents may enter the Premises upon reasonable notice to inspect, perform repairs, or show the Premises to prospective tenants or purchasers. Except in the case of emergency, Landlord shall provide at least hours' notice prior to entry, unless otherwise required by law.

9. INSURANCE AND LIABILITY

Tenant is strongly encouraged to obtain renter's insurance covering Tenant's personal property and liability. Landlord's insurance does not cover Tenant's personal property. Tenant shall indemnify and hold Landlord harmless from claims arising from Tenant's negligence, breach, or misuse of the Premises.

10. DEFAULT AND REMEDIES

10.1 Events of Default. Tenant shall be in default upon failure to pay rent when due, abandonment, material breach of any covenant, or failure to cure any other default within the time specified in a written notice.

10.2 Landlord Remedies. Upon Tenant's default, Landlord may terminate this tenancy, pursue all available legal and equitable remedies, recover possession, obtain damages including unpaid rent, and recover costs and reasonable attorney's fees to the extent permitted by law.

11. NOTICES

All notices required or permitted shall be in writing and given by personal delivery, nationally recognized overnight courier, or first-class mail to the addresses set forth above or such other address as a party may designate by written notice. A notice is deemed given when delivered or three days after deposit in the mail, postage prepaid, unless a different period is required by law.

12. GOVERNING LAW; DISPUTE RESOLUTION

This Rental Terms shall be governed by and construed in accordance with the laws of the State of . Any litigation arising under this Rental Terms shall be brought in the state or federal courts located in the county where the Premises are located, and the parties submit to the jurisdiction of such courts. No oral statements or representations shall modify these terms.

13.2 Severability. If any provision of this Rental Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Amendment. This Rental Terms may be amended only by a written instrument executed by both parties.

13.4 Waiver. Failure of either party to enforce any provision of this Rental Terms shall not constitute a waiver of that provision or of the right to enforce it later.

14. MISCELLANEOUS

14.1 Counterparts. This Rental Terms may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one instrument. Signatures delivered by electronic transmission shall be valid and binding.
