RESIDENTIAL SHORT TERM RENTAL AGREEMENT

This Residential Short Term Rental Agreement ("Agreement") is entered into between the Host/Owner and the Guest on the terms set forth below. Host and Guest agree that the Host will rent the Property to Guest for the Term and Rent described herein, subject to the conditions, rules and covenants contained in this Agreement.

FINANCIAL TERMS

Security deposit will be held to cover damages, excessive cleaning, unpaid fees, or breach. Host shall provide a written itemized statement of deductions and return remaining deposit within days after Check-out.

CANCELLATION & REFUND

Cancellation more than days before Check-in: Full refund less non-refundable fees. Cancellation between and days before Check-in: refund. Cancellation less than days before Check-in: No refund unless otherwise agreed in writing.

OCCUPANCY, PETS & HOUSE RULES

Maximum permitted occupancy: persons. No persons beyond this number shall stay overnight without prior written consent of Host.

GUEST RESPONSIBILITIES & DAMAGES

Guest shall keep the Property clean and in the same condition as at Check-in and shall be responsible for all damage caused by Guest or Guest's invitees. Host may charge Guest reasonable costs to repair or replace damaged items. Host will provide an itemized invoice of deductions from the security deposit and will return any remaining deposit within the stated timeframe.

HOST ACCESS, MAINTENANCE & EMERGENCIES

Host may enter the Property during the Term for reasonable purposes including maintenance, inspection or emergencies. Except in emergencies, Host will provide advance notice of intended entry. Host shall use reasonable efforts to avoid intrusion and to coordinate any necessary entry with Guest.

INSURANCE & LIABILITY

Guest is encouraged to obtain travel or renters insurance covering personal injury or loss. Host is not responsible for Guest's personal property. Guest agrees to indemnify and hold Host harmless from and against any claims arising from Guest's use of the Property except to the extent caused by Host's gross negligence or willful misconduct. Host's total liability for any claim arising under this Agreement shall not exceed the total amount paid by Guest for the stay.

DEFAULT, REMEDIES & TERMINATION

Material breach by Guest, including failure to pay, illegal activity, or repeated violation of house rules, entitles Host to terminate this Agreement immediately and pursue available remedies, including retention of all amounts paid and recovery of additional damages. Exercising one remedy does not waive Host’s right to pursue others.

GOVERNING LAW, DISPUTE RESOLUTION & MISCELLANEOUS

This Agreement shall be governed by the laws of the state in which the Property is located. The parties agree to attempt mediation of disputes in good faith prior to initiating litigation. If mediation fails, the prevailing party shall be entitled to recover reasonable attorneys' fees and costs. This Agreement constitutes the entire agreement between the parties and may be amended only by a written instrument signed by both parties. If any provision is held unenforceable, the remainder shall remain in full force and effect.
