What a Resort Rental Agreement Covers

A Resort Rental Agreement is a legally binding contract between a property owner or manager and a short-term guest that documents booking dates, rent and payment schedule, security deposit, permitted occupancy, guest responsibilities, cancellation policy, damage procedures, and governing law. In the United States these agreements are generally enforceable when signed electronically under the ESIGN Act (15 U.S.C. ch. 96) and UETA where adopted, except for limited statutory exceptions.

Why a Clear, Written Agreement Matters

A written Resort Rental Agreement allocates liability, sets payment and cancellation terms, documents condition and access rules, and reduces disputes. A precise contract protects owners and guests, supports insurance claims, and enables consistent enforcement of house rules while permitting secure electronic signatures under U.S. e-signature laws.

Why a Clear, Written Agreement Matters

Who Typically Prepares and Signs These Agreements

Several parties commonly complete or sign Resort Rental Agreements depending on the property type and management structure.

  • Property owners and individual hosts who rent a second home or condo directly to guests.
  • Resort management companies and property managers handling bookings, maintenance, and guest communications.
  • Travel agencies, short-term rental platforms, or corporate travel teams arranging stays for clients or employees.

Choose the role that best matches your situation when routing signatures and storing the executed agreement.

Step-by-Step: Completing the Resort Rental Agreement

Follow these sequential steps to create a complete, enforceable agreement and prepare it for signature and delivery.

  • 01
    1. Prepare: Gather property details and payment terms before drafting.

  • 03
    3. Attach Docs: Add house rules, inventory lists, and local disclosures.
  • 04
    4. Sign: Collect signatures with an audit trail and authentication.

Where to Send the Completed Agreement

Decide delivery and filing destinations based on your workflow: guest copy, property manager, accounting, and escrow or payment processor if applicable.

  • Guest Copy: Provide a signed PDF to the renter via email or link.
  • Property Manager: Store a master copy with reservations and maintenance teams.
  • Accounting: Send billing and deposit details to finance for reconciliation.
  • Payments: Route payment receipts to payment provider for records.

Common Preparation Mistakes to Avoid

  • Failing to attach house rules, access instructions, or property inventory creates confusion about responsibilities and increases damage claim disputes.
  • Not specifying governing law or dispute resolution procedures can prompt jurisdictional fights and increase litigation costs.
  • Collecting payments without documented receipts or audit trails complicates refunds, tax reporting, and reconciliation during audits.
