Residential Room Lease Agreement

1. Owner hereby leases to Tenant and Tenant hereby leases from Owner one bedroom of the dwelling located at with common living areas

shared by Owner, for a term of beginning on and

on the first day of each calendar month to the Owner at the address set forth above. A late fee of $ will be assessed if the payment is not received by the day of each

month.

2. A security and cleaning deposit is payable prior to in the amount

of $ . This deposit is refundable if the Tenant leaves the dwelling reasonably clean and undamaged. This deposit will not earn interest unless otherwise required by law. Tenant may not use this deposit as payment of the last month's rent. Should it be necessary to retain part or all of the security deposit due to damage, cleaning, trash removal, or unpaid fees, an itemized statement will be provided to the Tenant.

3. Should the Tenant move before this Agreement expires, the Tenant will be responsible for paying rent through the end of the lease term or until another Tenant approved by the Owner has moved in, whichever comes first. All costs associated with searching for a new tenant will be the responsibility of the Tenant.

4. Said room is being leased as a furnished unit containing the items of household furniture, and other items listed in Schedule A attached to and made a part of this Agreement. No furnishings or other household items are furnished or leased with the room other than those listed in that Schedule. Tenant agrees to return all items listed in the schedule to Owner on the expiration of the tenancy in as good condition as when received, reasonable wear and tear excepted. Tenant, by the execution of this Agreement, accepts all items listed in the Schedule as being in good, serviceable condition. Tenant will be responsible for all breakage or other damage to items listed.

5. Owner shall pay for all water supplied to the premises and for regular waste removal. Owner shall also pay for all gas, electricity, telephone service, and other utilities except as otherwise provided in Agreement.

6. Tenant agrees that the room shall be occupied by no more than one person, consisting of Tenant without the written permission of Owner. Tenant shall not keep or permit to be kept on the premises any animal, bird, or other pet without Owner's prior, express, and written consent.

7. Owner reserves the right to enter the room at all reasonable hours for the purpose of inspection and whenever necessary to make repairs and alterations. Tenant grants permission to Owner to show the room to new rental applicants at reasonable hours of the day, within days of the expiration of this Agreement.

8. Assignment and Subletting. Tenant shall not sublet the room or any part of it, or assign this Agreement without Owner's prior, express, and written consent.

9. Any failure by Tenant to pay rent or other charges promptly when due or to comply with any other term or condition of this Agreement shall, at the option of Owner, promptly terminate this tenancy and forfeit all rights of Tenant under this Agreement.

10. In the event that any lawsuit is filed in relation to this Agreement, the unsuccessful party in the action shall pay to the successful party, in addition to all the sums that either party may be called on to pay, a reasonable sum for the successful party's attorney fees.

11. The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred.

12. Any modification of this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if placed in writing and signed by each party or an authorized representative of each party.
