ROOMMATE AGREEMENT

This Roommate Agreement (the Agreement) is made and entered into on by and between Roommate 1: and Roommate 2: (collectively, the Roommates).

WHEREAS

WHEREAS, the Roommates wish to share occupancy and certain household responsibilities at the Premises identified above; and

WHEREAS, each Roommate will pay a portion of rent and shared utilities and will comply with the terms of this Agreement; and

WHEREAS, the Roommates desire to set forth their respective rights and obligations to avoid misunderstandings and to provide a mechanism for resolution of disputes.

SCOPE OF SHARED RESPONSIBILITIES

The Roommates agree on the allocation of household tasks, cleaning responsibilities, and shared rules. The Roommates shall describe the agreed duties and routines below.

PAYMENT TERMS

The Roommates agree to share the financial obligations for the Premises as follows:

TERM AND TERMINATION

This Agreement commences on and continues through unless earlier terminated in accordance with this Agreement.

Early termination by a Roommate may require that Roommate to pay any outstanding rent and prorated share of utilities through the end of the notice period. Any amounts owed for damages, unpaid rent, or utilities may be withheld from the security deposit as permitted by law.

CONFIDENTIALITY

Each Roommate shall maintain in confidence any personal information of the other Roommate obtained in connection with occupancy and shall not disclose such information to third parties except as required by law or with the express written consent of the other Roommate. Confidential information includes but is not limited to financial account information, employment information, and personal contact details.

MAINTENANCE, REPAIRS, AND ALTERATIONS

Routine maintenance and minor repairs shall be the shared responsibility of the Roommates as set forth in the Scope of Shared Responsibilities. Major repairs must be reported promptly to the landlord or property manager. No Roommate shall make structural alterations or substantial cosmetic changes to the Premises without prior written consent of the other Roommate and the landlord where required.

GUESTS, SUBLETTING, AND OCCUPANCY

Guests staying more than consecutive nights require advance notice and approval from the other Roommate. Subletting or assigning any portion of the Premises requires prior written consent of the landlord and the other Roommate.

DEFAULT, REMEDIES, AND INDEMNIFICATION

A Roommate who fails to pay their share of rent or utilities, or who materially breaches this Agreement, shall be in default. The non-defaulting Roommate may seek contribution for unpaid sums, damages, and reasonable costs of collection. Each Roommate agrees to indemnify and hold the other harmless from claims, liabilities, and expenses arising from that Roommate's negligence or willful misconduct.

DISPUTE RESOLUTION

The Roommates agree to attempt in good faith to resolve any dispute arising under this Agreement through direct negotiation. If negotiation fails, the Roommates shall submit the dispute to mediation before pursuing litigation. Nothing in this paragraph prevents a Roommate from seeking injunctive relief to protect health or safety.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state where the Premises is located, without regard to its conflict of laws principles.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Roommates with respect to the subject matter hereof and supersedes all prior agreements, understandings, and representations, whether oral or written. Amendments to this Agreement must be in writing and signed by all Roommates.

What a Roommate Agreement Covers and Why It Matters

A Roommate Agreement is a written contract between co-occupants that defines shared obligations, financial arrangements, and behavioral expectations while living together. It typically addresses rent and utilities allocation, security deposit handling, cleaning schedules, guest and pet policies, subletting rules, and procedures for move‑out and dispute resolution. Although not a replacement for a residential lease with the landlord, a well-drafted Roommate Agreement reduces misunderstandings among roommates, preserves evidence of agreed terms, and creates a clear basis for resolving conflicts without immediately involving landlords or courts.

How a Roommate Agreement Protects All Parties

A clear Roommate Agreement documents responsibilities and payment allocations, limiting conflicts and financial exposure. It clarifies what happens if a roommate moves out, misses rent, or damages property, and it preserves evidence for security deposit disputes or small‑claims proceedings.

How a Roommate Agreement Protects All Parties

Who Typically Uses a Roommate Agreement

Roommate Agreements are commonly used by renters who share housing to set expectations and reduce disputes.

  • College students sharing an apartment during an academic year and splitting rent and utilities evenly.
  • Young professionals co‑renting to reduce housing costs while specifying work schedules and guest rules.
  • Extended households where one occupant sublets a room and requires clear payment and access terms.

Using a written agreement benefits both short-term cohabitants and longer-term shared households by creating clarity around money, chores, and exit procedures.

Roles and Signing Authority

Primary Tenant

If one roommate holds the landlord's lease, they should sign the Roommate Agreement as Primary Tenant and coordinate with other roommates; the primary tenant may remain legally responsible to the landlord even if roommates agree otherwise.

Co-Occupant

Each co-occupant should sign and date the agreement to establish mutual obligations and evidence intent; unsigned or informal arrangements are harder to enforce in dispute resolution or small-claims court.

Essential Sections to Include in a Professional Agreement

Include clear, discrete sections so each party understands obligations and remedies. Use plain language and, when helpful, attach schedules or exhibits for payment tables or cleaning rosters.

Rent & Payment

Specify total rent, each roommate's share, due date, late fees, and payment method to avoid ambiguity and provide evidence of payment obligations.

Utilities & Services

List utilities, payment splits, billing responsibility, and procedures if a bill is not paid; include internet, cable, trash, and shared subscription allocations.

Security Deposit

Record the deposit amount collected by the primary tenant or landlord and define how deductions and return procedures will be handled among roommates.

House Rules

Cover guests, quiet hours, pet allowances, smoking, cleaning expectations, and storage to set behavioral norms and reduce friction.

Move-Out & Replacement

Outline notice periods, pro rata rent responsibilities, and the process for finding a replacement roommate or assigning liability for early departure.

Dispute Resolution

Describe escalation steps for disputes — internal mediation, splitting costs of repairs, or small-claims court — and identify the governing state law for interpretation.

Core Information Fields to Capture

Full Names: Legal names of all roommates
Contact Details: Phone, email, and forwarding address
Property Address: Street, city, state, ZIP
Effective Date: Agreement start date
Financial Terms: Rent split and deposit amounts
Signatures: Signed and dated by each party

Step-by-Step: Create and Execute a Roommate Agreement

Follow these sequential steps to produce a clear, enforceable agreement and ensure all roommates understand their responsibilities.

  • 01
Collect Details: Gather names, contact info, rent amounts, and move-in dates from all roommates.
  • 02
Draft Terms: Write clear provisions for rent, utilities, rules, and deposits using plain language.
  • 03
Review Together: Circulate the draft, discuss changes, and reach unanimous agreement on edits.
  • 04
Sign and Share: Have all roommates sign, date, and retain identical copies for recordkeeping.

Customize an Online Signing Workflow

Set up a digital workflow to place fields, control signer order, and capture authentication and audit data for each signature event.

Field Configuration
Signature Field Assign to each roommate; require date stamp
Initials Field Place on each page section for acknowledgement
Attachment Field Allow proof of ID upload if required
Authentication Choose email link or SMS code verification

Digital Signing and Storage Considerations

Use a platform that supports common file formats, secure storage, and a detailed audit trail for eSignatures.

  • File Formats: PDF and DOCX supported
  • Authentication: Email or SMS verification
  • Storage: Encrypted cloud storage

Where to Send the Completed Agreement

After execution, distribute identical final copies to all parties and retain a secure master copy for reference and dispute resolution.

  • All Roommates: Email each signed PDF for personal records
  • Primary Tenant: Provide a copy for lease coordination with landlord
  • Cloud Archive: Store encrypted master copy in shared cloud folder
  • Insurance Provider: Share if renter's insurance requires named occupants

Common Timelines and Notice Periods to Define

Specify recurring dates and notice windows to avoid ambiguity and comply with state landlord‑tenant timelines where applicable.

Monthly Rent Due Date:

Set a consistent day each month for payments

Late Fee Policy:

State grace period and late fee amount clearly

Move-Out Notice:

Recommend 30 days' written notice unless agreed otherwise

Deposit Accounting:

Document timeline for internal division of landlord deductions

Repair Reporting:

Require prompt notice for damage to limit disputes

Key Milestones from Draft to Post‑Move‑Out

Track milestones so responsibilities and deadlines are visible throughout the tenancy lifecycle.

01

Draft Agreement

Create initial terms and share for review with roommates

02

Sign & Execute

All roommates sign; record execution date and circulation

03

Move-In Inspection

Document condition jointly to support later deposit claims

04

Move-Out Reconciliation

Allocate deposit deductions and finalize balances after tenancy

Common Mistakes to Avoid

  • Using vague language for payments or notice periods, which leads to differing interpretations and disputes.
  • Failing to document agreed splits for variable utilities, resulting in late or unpaid bills and strained relationships.
  • Relying solely on verbal agreements or text messages without signed copies, making enforcement difficult in small-claims court.
  • Not specifying who notifies the landlord of roommate changes, which can create liability gaps and lease violations.

Potential Consequences of an Improper or Missing Agreement

Security Deposit Dispute: Loss of deposit share
Payment Liability: Remaining roommates may cover unpaid rent
Lease Violation: Risk of eviction for unauthorized sublets
Insurance Gap: Claims denied if occupants unlisted
Credit Impact: Unpaid bills may affect credit
Legal Costs: Small-claims or attorney fees

Two Typical Roommate Agreement Scenarios

Illustrative examples show how clauses work in practice and what to document when household situations change.

College Cohabitation

Three roommates share rent and utilities during the academic year

  • They agree to split utilities by usage percentage
  • The agreement specifies move-out notice, a joint inspection, and prorated rent to avoid disputes when a roommate leaves mid-term.

Professional Flatmates

Two professionals sign for a year-long lease and split chores and cleaning costs

  • One partner travels frequently and covers a larger share of utilities
  • The contract records this arrangement and names an approved roommate replacement process if either party must break the agreement.

Practical Tips for Clear and Enforceable Agreements

Follow straightforward drafting and signing practices that improve clarity and reduce enforcement friction.

Be Specific with Money Terms
List exact dollar amounts, due dates, acceptable payment methods, and late fee mechanics to avoid disputes and simplify accounting.
Document Condition at Move-In
Use dated photos and a signed move-in checklist to support future deposit reconciliation and damage claims.
Agree on Communication Rules
Specify how and when official notices should be delivered (email, text, or certified mail) and require written confirmations for changes.
Review Periodically
Revisit the agreement when circumstances change — e.g., new roommate, rent increase, or extended absences — and document amendments in writing.
