SAFARI ADVENTURE AGREEMENT

Parties and Recitals

This Safari Adventure Agreement ("Agreement") is made effective as of by and between , the operator of safari services (the "Operator"), and , the client contracting for the safari services (the "Client").

WHEREAS, Operator is engaged in the business of providing guided wildlife safaris, transportation, accommodation coordination and related services in remote and wilderness areas; and

WHEREAS, Client desires to engage Operator to provide a safari package on the terms set forth in this Agreement and Operator accepts such engagement subject to the terms and conditions contained herein.

Operator will use reasonable skill and care in providing services in accordance with customary industry standards.

Either party may terminate this Agreement for material breach by the other party if the breach remains uncured for days after written notice. Termination by Client for convenience is subject to the cancellation and refund terms above.

Confidentiality

Each party shall keep confidential and shall not disclose to any third party any confidential information of the other party, including pricing, proprietary procedures, client lists and operational details, except as required by law or as reasonably necessary to perform under this Agreement. Confidential information does not include information that is or becomes publicly known through no wrongful act of the receiving party.

Liability, Insurance and Indemnity

Client acknowledges that participation in safari activities involves inherent risks, including but not limited to wildlife encounters, uneven terrain, weather, and remote medical access. Client agrees to assume such risks and to hold Operator, its employees, guides and agents harmless from and indemnified against claims arising from participation in the safari except to the extent caused by Operator’s gross negligence or willful misconduct.

Force Majeure

Neither party shall be liable for delays or failures in performance caused by acts beyond its reasonable control, including natural disasters, government action, war, terrorism, strikes, epidemics, or closure of parks or reserves. In the event of such force majeure, the parties shall cooperate to reschedule services or agree an equitable adjustment to fees.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of . The parties agree to attempt amicable resolution of any disputes in good faith prior to initiating litigation. Venue for any litigation shall be in the appropriate courts of the chosen jurisdiction.

Entire Agreement

This Agreement, including any schedules and written amendments executed by both parties, constitutes the entire agreement between Operator and Client with respect to the subject matter hereof and supersedes all prior discussions, representations and agreements, whether oral or written. No modification of this Agreement shall be effective unless in writing and signed by both parties.
