SAFETY USAGE GUIDELINES FORM

THIS SAFETY USAGE GUIDELINES FORM (the Agreement) is entered into by the parties identified below as of the Effective Date. WHEREAS Provider Name: is engaged in providing equipment, access, and operational oversight for certain facilities and equipment; and

WHEREAS Client Name: requires use of Provider equipment or facilities subject to the safety requirements and usage limitations set forth herein; and

WHEREAS the parties intend to set forth guidelines, responsibilities, and remedies relating to safety, training, and permitted use effective as of Effective Date: .

Scope of Work

Provider will permit Client to access and use the following equipment, tools, and space under Provider's supervision and subject to the safety procedures below:

Safety Usage Guidelines

The parties agree the following safety rules are mandatory while Client is on Provider premises or using Provider equipment. Failure to comply constitutes material breach and may result in immediate removal and termination of access.

I will wear required personal protective equipment (PPE) at all times where posted.

I have completed required training for the specific equipment to be used and will follow operating procedures.

I will not operate equipment for any prohibited purpose, including but not limited to unauthorized modifications or bypassing safety systems.

I will immediately report any injury, near-miss, equipment malfunction, or unsafe condition to Provider.

Payment Terms

Client shall pay Provider in consideration for access, training, and oversight as set forth below. All fees are exclusive of applicable taxes unless otherwise stated.

Late payments will incur interest and/or fees as set forth below.

Term and Termination

This Agreement commences on Start Date: and, unless earlier terminated, continues until End Date: . Either party may terminate for convenience upon Notice Period (days): days' written notice. Provider may terminate immediately for material safety breaches or illegal conduct.

Confidentiality

Each party shall treat as confidential all non-public information disclosed in connection with this Agreement, including technical data, operational procedures, training materials, and incident reports (Confidential Information). Confidential Information shall not be used except as necessary to perform obligations under this Agreement and shall not be disclosed to third parties without prior written consent, except as required by law.

Incident Reporting and Emergency Contacts

All incidents, injuries, equipment damage, or near-misses must be reported immediately to Provider's on-site representative and documented in writing.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Governing Jurisdiction: without regard to conflict of laws principles. Exclusive venue for disputes shall be the courts of that jurisdiction, except where mandatory law provides otherwise.

Entire Agreement

This document, together with any attachments and written addenda executed by the parties, constitutes the entire agreement between Provider and Client regarding safety use and supersedes all prior agreements and understandings, whether written or oral. Any amendment must be in writing and signed by authorized representatives of both parties.

Acknowledgment
