Payroll Deduction Authorization

The Borrower authorizes the Lender and the Borrower's employer to deduct required installments from the Borrower's salary or wages in accordance with the repayment terms above. This authorization continues until the loan and any accrued interest, fees and costs are paid in full or the parties execute a written release.

Interest, Fees and Default

Interest shall accrue on the unpaid principal at the stated annual rate and shall be calculated on a 365-day year basis. Borrower agrees to pay a late fee equal to the lesser of $ or of the overdue installment for payments more than days past due.

Upon default, which includes failure to remit two consecutive installments or other material breach, the Lender may accelerate the balance, apply collection costs and enforce all remedies permitted by law, including but not limited to wage assignment and recovery of attorney fees and court costs.

The Borrower represents that all information provided is true and complete, that Borrower is an employee of the employer identified above, and that no material change in financial condition has occurred that would impair Borrower’s ability to repay. The Borrower covenants to maintain employment and to notify the Lender within ten (10) days of any resignation, termination or extended leave.

Governing Law and Miscellaneous

This Agreement shall be governed by and construed in accordance with the laws of the state or jurisdiction where the Borrower is employed. Any dispute arising under this Agreement shall be resolved in the competent courts of that jurisdiction. This Agreement constitutes the entire agreement between the parties and may be amended only by a written instrument signed by both parties. If any provision is held invalid, the remaining provisions shall remain in full force and effect.

Acknowledgment

Borrower acknowledges receipt of the principal amount set forth herein and understands the repayment obligations and payroll deduction authorization. Borrower further acknowledges that a copy of this signed Agreement will be retained by the Lender and a copy may be placed in Borrower's employment file where permitted by law.
