3. Tax, Superannuation and Entitlements

The Employee acknowledges and accepts that:

  1. Salary sacrificed amounts are made from gross salary and may affect tax payable, government benefits and employer superannuation guarantee calculations in accordance with applicable law.
  2. For superannuation sacrifice, the Employer will make contributions in accordance with the Employer's superannuation policy and statutory obligations; any shortfall or limitation is subject to the terms of that policy.
  3. The Employer does not provide tax advice. The Employee confirms they have obtained, or had the opportunity to obtain, independent taxation or financial advice in relation to this arrangement prior to signing.

4. Variation, Suspension and Termination of Arrangement

Either party may vary or suspend the salary sacrifice arrangement by giving written notice to the other party. Variation will take effect from a payroll date specified in that notice, subject to reasonable payroll processing time.

On termination of employment for any reason, salary sacrifice deductions will cease from the final remuneration payment. The Employer may recover any amounts that are required to be repaid or that were paid in error in accordance with payroll recovery provisions set out below.

5. Acknowledgements and Authorisations

By signing this Agreement the Employee:

  • Acknowledges that the salary sacrifice arrangements are subject to the Employer's payroll procedures and applicable law.
  • Authorises the Employer to make the specified deductions from gross salary and to allocate those funds to the benefit(s) nominated in this Agreement.
  • Authorises the Employer to recover any overpayment or administrative error from future pay or final entitlements to the extent permitted by law.

6. Privacy and Confidentiality

The Employer will use personal information provided in this Agreement for payroll and benefits administration. Personal information will be handled in accordance with the Employer's privacy policies and applicable data protection law. Both parties agree to keep confidential the terms and any commercially sensitive information arising from this Agreement except where disclosure is required by law.

7. Governing Law

This Agreement is governed by the laws of the jurisdiction in which the Employer operates. The parties submit to the non-exclusive jurisdiction of the courts of that jurisdiction.

Notices under this Agreement must be sent to the addresses set out above or to any updated address notified in writing by a party. Notice is effective on the date of delivery.
