SCUBA LIABILITY WAIVER AND SERVICE AGREEMENT

RECITALS

WHEREAS, Participant desires to engage in scuba diving, snorkeling, and related aquatic activities provided by Dive Operator under the terms set forth herein; and

WHEREAS, Dive Operator is qualified to provide instruction, equipment, supervision and related services and requires execution of this liability waiver and service agreement as a condition of participation; and

WHEREAS, the parties intend that this document allocate responsibility for risks, define payment and service terms, and provide releases, indemnities and dispute resolution terms.

SCOPE OF SERVICES

Dive Operator will provide scuba instruction, guided dives, snorkel activities and rental of diving equipment as requested by Participant. Specific services for the booking are described below.

PAYMENT TERMS

Participant agrees to pay Dive Operator the fees described below for services and equipment rental. Failure to pay when due may result in suspension of services and additional charges.

TERM AND TERMINATION

Services under this Agreement commence on and terminate on .

ASSUMPTION OF RISK AND RELEASE

Participant acknowledges that scuba diving and related water activities involve inherent risks including, without limitation, drowning, decompression sickness, lung over-expansion injury, equipment failure, collision, environmental hazards and other injuries or death. Participant voluntarily assumes all such risks whether known or unknown and accepts sole responsibility for all bodily injury, disability, death and property loss arising from participation.

In consideration of being permitted to participate, Participant releases, waives, discharges and covenants not to sue Dive Operator, its owners, officers, employees, agents, contractors and affiliates (collectively, Released Parties) from any and all liability, claims, demands, actions or causes of action arising out of or related to any loss, damage or injury, including death, that may be sustained by Participant, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

INDEMNIFICATION

Participant agrees to indemnify, defend and hold harmless the Released Parties from and against any and all claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys' fees) arising out of Participant's breach of this Agreement or Participant's negligent or intentional acts or omissions in connection with the services provided.

MEDICAL TREATMENT AUTHORIZATION

If Participant is injured or requires medical attention, Participant authorizes Dive Operator and its representatives to obtain necessary medical treatment and transport Participant to a medical facility. Participant is responsible for all costs of such treatment, evacuation and transport.

PHOTO AND VIDEO RELEASE

Participant grants Dive Operator the right to use, reproduce and publish photographs, video and other media of Participant taken during activities for promotional, training or commercial purposes without further compensation, unless Participant provides written objection prior to services.

CONFIDENTIALITY

The parties agree that any non-public information exchanged in connection with specialized training, proprietary procedures or business terms shall be treated as confidential and not disclosed to third parties except as required by law. This obligation does not apply to information that becomes publicly available other than by breach of this Agreement.

GOVERNING LAW; ENTIRE AGREEMENT

This Agreement shall be governed by and construed in accordance with the substantive laws of the state or jurisdiction where Dive Operator conducts the services, without regard to its conflict of law rules. Any legal action arising out of this Agreement shall be brought in the courts of that jurisdiction.

This Agreement constitutes the entire agreement between Participant and Dive Operator with respect to the subject matter hereof and supersedes all prior oral or written agreements, representations and understandings. Amendments must be in writing and signed by both parties.

ACKNOWLEDGMENT AND CERTIFICATION

By signing below, Participant certifies that Participant has read this Agreement in its entirety, understands its terms, has had the opportunity to ask questions and consult with advisors if desired, and agrees to be bound by its terms. Participant further certifies that all information provided on this form is true and complete to the best of Participant's knowledge.
