CONFIDENTIALITY

Each party shall maintain in confidence all non-public information disclosed in connection with this Agreement. Confidential information shall not include information that is or becomes publicly available other than through a breach of this Agreement, or that is independently developed without reference to the other party's confidential information.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction specified below, without regard to conflict of law principles.

ENTIRE AGREEMENT

This Agreement, including any attachments or addenda signed by the parties, constitutes the entire agreement between Participant and Dive Operator relating to the services and supersedes all prior and contemporaneous agreements, representations and understandings, whether oral or written.

RELEASE, ASSUMPTION OF RISK AND CERTIFICATION

I acknowledge that scuba diving involves inherent risks including but not limited to drowning, decompression sickness, barotrauma and other injuries. I freely accept and fully assume all such risks and the possibility of personal injury, death or property damage. I release, waive and covenant not to sue Dive Operator, its officers, employees, agents and contractors for any liability, claim, loss or expense arising from participation in scuba activities, except for gross negligence or willful misconduct.
