What a Self Dirt Agreement Covers

A Self Dirt Agreement is a written contract used in construction, landscaping, and property development to document that one party (often the property owner or a designated contractor) will perform excavation, soil removal, grading, or fill placement work itself rather than outsourcing to a contractor. The agreement allocates scope, responsibility for permits, testing and disposal, insurance and indemnity, and payment terms. It reduces ambiguity about who controls site conditions, who retains liability for contamination or damage, and which party is responsible for compliance with local environmental and permitting rules.

Why a Self Dirt Agreement Matters

A clear Self Dirt Agreement minimizes disputes by assigning practical responsibilities — who provides equipment, obtains permits, performs soil testing, and pays disposal fees — and by documenting acceptance of site conditions and risk allocation in writing.

Why a Self Dirt Agreement Matters

Who Typically Uses a Self Dirt Agreement

Use the agreement when site conditions, permit responsibilities, or cost-sharing require documented acceptance and clear assignment of environmental and operational risk.

  • Property owners and developers who choose to manage excavation or hauling themselves rather than hire a dirt subcontractor.
  • General contractors who accept owner-performed earthwork and need a written allocation of risk and inspection rights.
  • Soil haulers, landscapers, and excavation subcontractors who require clear disposal, testing, and access instructions.

Core Elements to Include in a Professional Agreement

A practical Self Dirt Agreement contains defined work, deliverables, safety and testing requirements, and liability protections so all parties know obligations and how to resolve problems.

Scope

Precisely describe excavation, grading, and soil volumes. Specify boundaries, elevation targets, and accepted tolerances so performance can be measured and disputes reduced.

Site Plan

Attach a labeled site plan or exhibit showing work areas, haul routes, stockpile locations, and access points to prevent misunderstandings about site logistics and rights-of-way.

Soil Testing

State required testing (e.g., compaction, contamination) and laboratory standards. Define responsibility for sampling, chain of custody, and acceptable results.

Permits & Compliance

Allocate who obtains permits, pays fees, and ensures erosion control, stormwater, and environmental compliance under local and state regulations.

Disposal Plan

Specify disposal sites, hauling procedures, disposal receipts, and responsibility for contamination remediation or extra disposal costs if material is unsuitable.

Indemnity & Insurance

Set insurance minimums and indemnity language for property damage, bodily injury, and pollution events, and clarify which party defends and pays claims.

Essential Information to Include

Full Legal Name: Legal name of each party
Property Address: Street, city, state, ZIP
Work Description: Concise scope statement
Effective Date: MM/DD/YYYY
Signatory Authority: Title or capacity
Insurance Limits: Policy types and amounts

Step-by-Step: Completing a Self Dirt Agreement

Follow a simple sequence to reduce errors: confirm parties and site, define work, attach exhibits, and obtain signatures with appropriate authentication or notarization.

  • 01
Review Document: Confirm names, site, and scope match project plans.
  • 02
Enter Details: Fill the address, volumes, testing, permits, and payment terms.
  • 03
Attach Exhibits: Add site plan, permit copies, and testing protocols.
  • 04
Sign & Authenticate: All parties sign and date; notarize if required.

How to Configure This Agreement for Online Completion

Set up fields and authentication to match the document's legal needs: signature, date, attachments, conditional clauses, and reminders.

Field Configuration
Signature type Allow typed, drawn, or uploaded signatures
Authentication Use email or SMS code verification
Conditional clauses Show permit clause only if owner-obtained
Notifications Auto-send signed copy to each party

Where to Send or File the Signed Agreement

After signing, deliver the executed agreement to parties and any third parties that rely on it, and maintain a record for compliance and audits.

  • Primary Parties: Send fully executed copies to owner and contractor
  • Lender or Title: Provide copy to lender or title company if requested
  • Local Agency: Submit permit-related exhibits to permitting authority
  • Project File: Store executed agreement in project records

Technical Considerations for Digital Completion and Sharing

Ensure the chosen service provides tamper-evident signed PDFs, document retention, and export options; consider API or SSO if integrating with project management or accounting systems.

  • File Formats: PDF, DOCX supported
  • Integrations: CRM and cloud storage connectivity
  • Authentication: Email, SMS, or stronger methods

Common Timeframes and Contract Deadlines

Include explicit timing in the agreement for work completion, testing, dispute notice, and document retention so obligations are enforceable and measurable.

Work Completion:

Specify calendar days or milestone dates for finishing work

Testing Window:

Require soil testing within 7–14 days of excavation

Permit Responsibility:

State who obtains permits and associated timelines

Dispute Notice:

Require written notice within 10–30 days of defect discovery

Record Retention:

Keep documentation per retention rules in this guide

Common Mistakes to Avoid

  • Vague scope descriptions that omit volumes, elevations, or limits of grading cause disputes and change-order claims.
  • Failing to attach a site plan or permit copies can leave parties uncertain about access, haul routes, or environmental restrictions.
  • Not specifying who pays for unexpected contaminated soil can shift large remediation costs after work begins.
  • Missing signatory authority or failing to notarize when required can delay enforcement and raise lender or title objections.

Risks and Potential Consequences

Liability Exposure: Expanded if indemnity is absent
Permit Violations: Fines and stop-work orders possible
Environmental Remediation: Significant cleanup costs
Contract Disputes: Delay and litigation risk
Title or Lender Issues: Insurance or closing holds
Invalid Signature: Enforceability problems if not authenticated

Example Use Cases and Real-World Results

Two illustrative customer stories show how documenting self-performed dirt work reduces delay and clarifies liability on site.

Martin Properties — Site Work

A small developer formalized owner-performed grading to avoid contractor confusion

  • Saved time on approvals by clarifying roles
  • "I can process and execute all of these documents online with 100% compliance and built-in security," said Tim Martin, Founder, describing faster handoffs and fewer on-site disputes.

BIS — Risk Allocation

A general contractor required owners to sign a dirt allocation agreement before mobilization

  • Reduced change-order claims after acceptance of site condition
  • Dan Rotelli, CEO, noted that SOC 2-backed eSignatures provided auditability and helped resolve a delayed remediation claim quickly.
