What the Seller Compensation Real Estate Addendum Is

The Seller Compensation Real Estate Addendum is a contract amendment used in residential and commercial real estate transactions to record and allocate compensation that the seller agrees to pay to buyer-side brokers or other parties. It supplements the purchase agreement by stating the amount or percentage of compensation, payment timing, escrow instructions, and any conditions that affect payment. The addendum creates a clear, written record to reduce disputes, supports MLS compliance when compensation appears on listings, and becomes part of the enforceable contract once signed by the relevant parties.

Why adding a compensation addendum matters

A clear Seller Compensation Real Estate Addendum prevents misunderstandings about broker fees, aligns payment timing with closing procedures, and supports regulatory and MLS disclosure requirements.

Common users include agents, sellers, and brokers handling commission arrangements for a real estate sale.

Clear roles and signatures on the addendum reduce the risk of post-closing disputes and listing compliance errors.

Common errors when preparing the addendum

  • Using vague compensation language such as 'mutual agreement' without a dollar amount or percentage causes later disputes and ambiguous escrow handling.
  • Failing to match signer names to title records or government ID can delay escrow and require corrective amendments before closing.
  • Not updating MLS listing compensation after an addendum change can lead to broker complaints, commission disputes, and possible marketplace penalties.
  • Omitting payment timing or escrow instructions leaves brokers uncertain about when and how they will receive commission disbursements.

Seller

The seller authorizes payment by signing the addendum; their signature creates the obligation to pay the specified compensation subject to closing and escrow conditions.
