What a Service Will Serve Agreement Is and when it’s used

A Service Will Serve Agreement documents a utility or municipal commitment to provide service to a specific parcel, project, or development. It typically identifies the applicant, property, requested service types (water, sewer, electricity, gas), capacity limits, connection conditions, and any fees or conditions precedent. The agreement creates contractual expectations for both the service provider and the property owner or developer, and is commonly required before permitting, final plat approval, or service connection.

Why the Service Will Serve Agreement matters for development and permitting

The agreement secures the supplier’s commitment and clarifies obligations, timing, and costs, reducing permitting delays and financing uncertainty. It is a practical prerequisite for zoning approvals, utility hookups, and construction scheduling.

Why the Service Will Serve Agreement matters for development and permitting

Typical users and signers for a Service Will Serve Agreement

Identifying the right signer and approver prevents execution delays and ensures obligations are assigned correctly.

  • Developers and property owners seeking utility connections for new construction or subdivision.
  • Municipal utilities, investor-owned utilities, or water districts documenting service commitments and conditions.
  • Design professionals, civil engineers, and permitting agents coordinating service capacity and inspections.

Step-by-step: completing and submitting the agreement

Follow these sequential steps to prepare, approve, and file a Service Will Serve Agreement with the utility and permitting authorities.

  • 01
Prepare draft: Gather parcel ID, utility plans, load calculations, and fee estimates before drafting.
  • 02
Confirm capacity: Utility reviews requested capacity and provides any reservation conditions or infrastructure needs.
  • 03
Obtain signatures: Authorized signers sign; notarization or witnesses added if required by the utility or local law.
  • 04
Submit to utility: Send completed agreement and supporting documents to the utility’s engineering or permitting office.

Routing and filing: where the signed agreement goes next

Understand typical routing so you can track approvals and scheduling after the agreement is signed.

  • Utility Engineering: Primary reviewer for capacity, connection requirements, and inspection scheduling.
  • Permitting Agency: Local planning or building department may require the agreement for permits and final plat approvals.
  • Finance / Billing: Billing or finance records the fees, deposits, and service account setup.
  • Developer / Owner: Retain executed copies for recordkeeping and lender or purchaser due diligence.

Configuring an online workflow for digital completion

Set up an electronic workflow that captures signatures, key dates, and supporting plans while maintaining an audit trail.

Field Configuration
Signature Field Require signer name and date with signer authentication
Conditional Fields Show connection details only when specific service types are selected
Attachments Allow PDF/DWG uploads for plans and load calculations
Audit Trail Capture IP, timestamp, and action log for each signer

Digital signing and technical prerequisites

Ensure the platform supports audit trails, secure storage, and any required notarization or identity-proofing.

  • File formats: PDF or DOCX accepted
  • Authentication: Email, SMS code, or advanced ID verification
  • Integrations: CRM and cloud storage connectivity

Common mistakes that delay approval or connection

  • Submitting incomplete load calculations or wrong capacity units, which forces resubmission and adds weeks to schedule.
  • Using mismatched names or lacking proof of signer authority, causing utilities to reject or require additional documentation.
  • Failing to attach required plans, easements, or permits, which prevents final approval and inspection scheduling.
  • Relying on an unsigned or improperly authenticated electronic signature where the utility requires notarization or stronger ID verification.

Practical risks and potential consequences of errors

Project delays: Inspection and permitting postponement
Increased costs: Reinspection or expedited fees
Service denial: Connection withheld until conditions met
Liability exposure: Failure to meet capacity obligations
Contract disputes: Ambiguous terms invite litigation
Record rejection: Noncompliant signatures may be invalid

Typical timelines and processing expectations

Processing times vary by utility and project complexity. The following are common timeline milestones to set expectations.

Submission to initial review:

Allow 2–4 weeks for engineering intake and initial comments

Conditional approval window:

Utility may issue conditional approval within 2–6 weeks after corrections

Inspection scheduling:

Schedule inspections 1–3 weeks after construction readiness

Final connection:

Final hookup typically occurs after inspection and fee payment

Permit finalization:

Municipal final plat or occupancy often follows connection and clearance
