Settlement Payment Extension Form

Identification of Parties

WHEREAS

WHEREAS, Claimant and Debtor entered into a settlement agreement to resolve the referenced obligation and to permit payment of the outstanding balance in accordance with the terms set forth therein; and

WHEREAS, Debtor has requested an extension to the payment schedule and Claimant is willing to grant a temporary extension subject to the terms and conditions set forth in this Settlement Payment Extension Form (the "Extension Agreement"); and

WHEREAS, the parties desire to record the revised payment schedule, any fees, and the duration of the extension in writing to avoid future disputes.

Scope of Settlement and Obligations

The parties agree that this Extension Agreement applies solely to the settlement obligation identified above and does not otherwise alter any terms of the original settlement agreement except as explicitly stated below.

Payment Terms

The parties agree to amend the payment provisions of the original settlement as follows. All capitalized terms used but not defined in this section shall have the meanings ascribed to them in the original settlement agreement.

Payments shall be applied first to any fees, then to accrued interest, and thereafter to principal. Failure to make any payment when due shall constitute default; upon default, Claimant may accelerate the balance or pursue remedies provided in the original settlement agreement, subject to any cure period specified in this Extension Agreement.

Term and Termination

Confidentiality

The parties acknowledge that the terms of this Extension Agreement and any non-public information disclosed in connection herewith shall be treated as Confidential Information and shall not be disclosed to third parties except as required by law, court order, or with the prior written consent of the other party. Confidential Information does not include information that is or becomes publicly available through no wrongful act of the receiving party.

Governing Law; Entire Agreement

This Extension Agreement shall be governed by and construed in accordance with the laws of the jurisdiction specified below, without regard to its conflict of laws rules. Any dispute arising under this Extension Agreement shall be resolved in the courts of that jurisdiction unless the parties agree otherwise in writing.

This Extension Agreement, together with the original settlement agreement as modified hereby, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, representations, and understandings, whether written or oral. No amendment to this Extension Agreement shall be effective unless in writing and signed by both parties.

Miscellaneous Provisions

If any provision of this Extension Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Neither party may assign its rights or obligations under this Extension Agreement without the prior written consent of the other party, except that Claimant may assign this Extension Agreement to an affiliate or in connection with a sale of its receivables.

All notices required or permitted under this Extension Agreement shall be in writing and delivered to the addresses set forth above or to such other address as either party may designate in writing.

Acknowledgment

By signing below, each party represents and warrants that it has the authority to enter into this Extension Agreement, that it has read and understands its terms, and that it voluntarily agrees to be bound by them.

What the Settlement Payment Extension Form Is

A Settlement Payment Extension Form is a written amendment to an existing settlement agreement that documents a change to the payment schedule or payment terms agreed by settling parties. It records who granted the extension, the revised payment dates or installments, any additional interest or fees, and conditions for default. The form creates a clear, signed record that reduces disputes, defines remedies, and can be enforced as a contractual modification when properly executed and retained according to applicable law.

Why formalize an extension with a written form

Using a Settlement Payment Extension Form preserves the parties’ intent, reduces ambiguity about new deadlines, and documents any added consideration or security. A signed amendment creates stronger evidence of mutual consent and supports enforceability under U.S. electronic and contract law when execution meets legal requirements.

Why formalize an extension with a written form

Who typically completes this form

The form is used by parties to a settlement—plaintiffs, defendants, claimants, insurers, or their counsel—when a payment schedule needs adjustment.

  • Individual claimants who need more time to pay or receive funds.
  • Corporate finance teams documenting amended installment schedules.
  • Attorneys or claims administrators executing and retaining signed amendments.

Versions are adapted for corporate settlements, individual claims, government recoveries, and structured payout arrangements.

Who can sign on behalf of a party

Authorized Signatory

A corporate officer or authorized agent with written authority may sign for a business. Confirm board resolutions or corporate authorization where required and attach evidence of that authority.

Settling Individual

An individual party must sign in their legal name as shown on government-issued ID. If a guardian or power of attorney signs, attach the valid power of attorney document.

Essential fields to include on the form

Party Names: Full legal names
Original Agreement: Reference date or docket
New Payment Terms: Amounts and due dates
Consideration: Any additional value
Signatures: Signed and dated
Notary Details: If required, acknowledgement

Consequences of errors or omissions

Unenforceability: Ambiguous terms may be void
Breach Costs: Accrue interest or fees
Tax Withholding: Backup withholding risk
Default Exposure: Acceleration of original debt
Litigation Risk: Increased enforcement costs
Record Issues: Retention violations possible

Common mistakes to avoid

  • Failing to reference the original settlement precisely, which creates uncertainty about which obligations were modified.
  • Leaving payment amounts or dates as vague ranges instead of fixed dates or clear installment schedules.
  • Omitting a statement of consideration when required by jurisdiction or when modification changes obligations.
  • Not capturing explicit signatory authority for corporate or trustee signers, risking later invalidation.

Key parts of a professional Settlement Payment Extension Form

A concise, well-structured form balances clarity with enforceability. Include a precise amendment clause, revised schedule, signatory blocks, and any security or conditional language.

Amendment Clause

A short clause stating this instrument amends the original settlement and identifying the original agreement by date or docket number.

Revised Schedule

A clear table of installment amounts and exact due dates, including time zone where payments are submitted electronically.

Additional Consideration

Describe any waiver, fee, or additional security provided in exchange for the extension, including interest rate or late fee terms.

Conditions

Any events that terminate the extension, cure periods, remedies for missed payments, and notice procedures for alleged breaches.

Signatures & Dates

Signature block for each party with printed name, title if applicable, and date of execution; include notary block if required.

Recordkeeping

Acknowledgement of delivery method and retention instructions so parties know where and how the signed amendment will be stored.

Where to file, send, or store the executed form

Decide routing before execution so all parties know where to submit and where the executed copy will be retained.

  • Primary Parties: Each party retains a signed original copy.
  • Counsel/Administrator: Send a copy to attorneys or claims administrator.
  • Court File: File with the court only if the original settlement required court approval.
  • Record Repository: Store in contract management or secure file storage.

Distribution and eSubmission options

Choose delivery methods that preserve the audit trail and meet authentication requirements for the parties involved.

  • Email Delivery: Suitable for low-risk amendments with clear audit trail.

Practical examples of use

Two anonymized examples show common scenarios where an extension form resolves timing issues without re-litigating the core settlement.

Small Business Installment

A small vendor received a 60‑day revenue delay and needed extra time to pay a settlement

  • The parties agreed a three‑installment schedule with interest
  • The signed extension documented the schedule, added a short cure period, and avoided further collection action by preserving the settlement’s original release terms.

Personal Injury Structured Payment

A claimant requested a later lump sum due to medical billing timing

  • Defendant agreed to defer payment by 90 days for a modest waiver of late charges
  • The amendment specified the new date, confirmed release language remained in force, and the court received a courtesy copy where the settlement was court‑approved.

How to export and save final copies

Save executed extensions in durable formats and preserve accompanying evidence like audit trails and notary acknowledgements.

PDF/A Export

Save a PDF/A copy to preserve document fidelity and metadata for long-term archival and legal admissibility.

Signed Certificate

Include the audit trail or certificate of completion showing timestamps, signer IPs, and authentication method.

Download Formats

Store copies as PDF and, if required, a searchable text or DOCX version for internal processing.

Backup Storage

Retain copies in secure document management or cloud storage with access controls and version history.
